Amend the Aventura Constitution​

BE IT ENACTED by the Mayor and Council of Aventura:

1 - Preamble
(1) This Act may be cited as the 'Counsel of Aventura Act'.
(2) This Act shall be enacted immediately upon its signage.
(3) This Act has been authored by Deputy Mayor Venne Montclair.

2 - Reasons
(1) As determined by Staff Intent, the Council of Aventura must have at most five members, inclusive of the Mayor and Deputy Mayor.
(2) The most reasonable option to achieve this is to disband the Office of Legal Affairs and to turn the Head of Legal Affairs into an advisory position, referred to as the Counsel of Aventura.

3 - Amendments
The Aventura Constitution is amended as follows:

(1) Article I, Section IV, Subsection 3 is struck in its entirety, whereupon Subsection 4 is renumbered as Subsection 3.

(2) Article I, Section V is amended by inserting a new Subsection (2) immediately following Subsection (1), and renumbering existing Subsection (2) as Subsection (3). The inserted Subsection (2) shall read as follows:

(2) The Mayor may appoint a Counsel of Aventura, who investigates and prosecutes crime on behalf of the Town of Aventura, represents the Town of Aventura in legal matters, and provides legal advice and counsel to the Mayor, Deputy Mayor and Council of Aventura. The Counsel of Aventura works under the responsibility of the Mayor.

4 - Transitional Provisions
(1) Section 3 of this Act enters into effect when the office of Head of Legal Affairs becomes vacant through any means, including through resignation, removal or through the end of the term of the current occupant of the office being reached.
(2) No further elections shall be held for the office of Head of Legal Affairs from the moment this Act is enacted.
