Bill: Draft Constitutional Supremacy Clarification Act

Amend the Constitution of Aventura

BE IT ENACTED by the Mayor and Council of Aventura:

1 - Short Title(1) This Act may be cited as the 'Constitutional Supremacy Clarification Act.'
(2) This Act shall be enacted immediately upon its signage.
(3) This Act has been authored by Mayor Budgiebud.

2 - Reasons
(1) Article V currently allows external Executive Orders to potentially override town governance.
(2) The Town Rights Expansion Act (Commonwealth Constitution) grants towns autonomy over their own offices and elections.
(3) This bill ensures that external orders cannot bypass the democratic protections guaranteed to the people of Aventura.

3 - Amendments
(1) Article V, Section (1) of the Constitution of Aventura shall be amended to read:

"(1) In accordance with Article IV of this Constitution, the Constitution of the Commonwealth of Redmont is the supreme law of the land. Commonwealth Executive Orders and Policies shall be binding only insofar as they do not infringe upon the Town’s autonomous jurisdiction over its own governance, offices, and elections as guaranteed by the Commonwealth Constitution."

(2) Article VII (Definitions) of the Constitution of Aventura, under the definition of "Vacant Office," subsection (b) shall be amended to read:

"(b) is removed through the internal constitutional processes of the Town of Aventura or by a court of competent jurisdiction;"

4 - Continuity
(1) This amendment serves to harmonize the Town Constitution with the superior protections provided in the Town Rights Expansion Act .
