Charge Conspirators​

The people of Democracy Craft, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as the “Conspiracy Act 2020”.
(2) This Act shall be enacted immediately upon its signage.

2 - Conspiracy to Commit An Act of Crime
(1)If An Individual/entity(business/organisation) intends to commit a crime they can be charged with “Conspiracy”.
(2) If any other individuals/entities(business’s/organisation’s) are involved in the “Conspiracy” but are not the primary culprit they can also be charged.
(3) If an individual/entity has knowledge of someone preparing to commit a crime, and have not presented this information to the relevant authorities eg. the Department of Justice. They then can also be charged

3 - Process for Charging Conspiracy
(1)In order for anyone to be punished for “Conspiracy” the State(Government) must sue the entity(person)/entities(people) involved in the conspiracy.
(2)The judge will be the one to decide whether or not the entity(person)/entities(people) were in fact conspiring to commit a crime.
Note:
The entity will not be found guilty if:
(1)It was a Joke
(2)If the individual was blackmailed or threatened by an entity/entities to not report the “Conspiracy”.
(3)If the Individual was blackmailed or threatened into partaking in the “Conspiracy”.
(Determined by the Court)

4 - Punishments
(1)Depending on whether the Crime is a misdemeanour or a felony the punishments will vary.
Note: Misdemeanours must be charged as “Conspiracy to Commit a Misdemeanour” and Felonies must be charged as “Conspiracy to Commit a Felony” they can only be punished within the bounds specified below, depending on the crime severity.

2 - Conspiracy to Commit An Act of Crime

(1) An entity involved in malice aforethought, who is also seen discussing said crime with another individual, if found guilty will receive punishment (see section 3).
(2) An entity involved in supporting someone in malice aforethought will be punished (see section 3)
(3) An entity involved in the knowledge of someone preparing to commit a crime, and have not presented this knowledge to staff or police will be punished (see section 3)
(a) The crime must be in laws/rules to apply to this


3 - Punishment for Committing Acts of Conspiracy
(1) To be punished the state has to sue the entity involved in the conspiracy. The judge will be the one to decide whether the entity was in fact conspiring or not. The entity will not be found guilty if: the judge perceives the conspiracy as a joke, if the individual was blackmailed or incite to commit conspiracy or if the judge is presented any other evidence that proves the entity to be not guilty. This also applies to the Knowledge of Conspiracy Individuals. They will be found not guilty if: They are threatened, blackmailed, or incite to keep them from telling authorities about the conspirator.
(2) If the entity is found to be guilty in committing conspiracy it will be therefore judged by the court on how severe the act is. The table of punishments is below:
