CLEAN UP THE CRIMINAL AND CIVIL CODE & INCREASE PENALTIES​

The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

PART I - PRELIMINARIES

1. Short Title and Enactment
(1) This Act may be cited as the ‘Code Clean-Up Act’

(2) This Act shall be enacted immediately upon its signage.

(3) This Act has been authored by _GreyMC and Former Representative Cr_2007.

(4) This Act has been co-sponsored by Representative HatManMC.

(5) This Act amends the following:

(a) Criminal Code Act
(b) Jail Activities Act
(c) Redmont Civil Code Act

2. Reasons and Intent
(1) With the Jaron Wave, many new players are finding ways around the criminal code. This includes times where people fishing rod players up and cause them hearts lost, but don’t “hit” the player. This act will change assault and attempted murder to causing the loss of hearts, instead of just hitting the player.
(2) Also, many criminals repeat small offenses, like NPC or ATM Robbery, and barely get any jail time for it. This act will scale small acts that only result in fines.
(3) This act also revives the Summary Offenses Addition Act without the ex-post facto, leaving it up to the DHS officers jurisdiction depending on how much was sold for buffing offenses.
(4) This also stops lazy policing by requiring police to actually catch bank robbers instead of just using the /map feature.
(5) This also fixes some errors with Buffing offenses as the title was said twice.
(6) Oh, and the title lies. It also amends some civil torts that the DHS fines for.. sorry!!
(7) This act also implements amendments into the CCA that should have been with assented and auto-assented bills during the strike, but since there was no CCA, these amendments were void.

PART II - AMENDMENTS

3. Amendments to the Criminal Code Act
(1) The following shall be enumerated into the Criminal Code Act as Part I, Section §6(12):

(12) Voluntary Surrender
(a) A person may voluntarily surrender themselves to police officer via going into a police station or opening up a DHS ticket when they are wanted for only summary offenses.
(b) If a person voluntarily surrenders themself, they may qualify for a reduced sentence and fine pursuant to Department of Homeland Security policy.
(i) A person's penalties may not be reduced by more than 50% if they surrender themselves.

(2) Part II, Section §9 of the Criminal Code Act shall be amended as follows:
9 - Obstruction of Government Department
Offence Type: Indictable
Penalty: Up to 60 minutes imprisonment; 3Up to 30 Penalty Units
A person commits an offence if the person:
(a) willfully threatens or harms an employee of a government department during the course of that employee’s official and lawful duty; or
(b) willfully takes action to impede an employee of a government department during the course of that employee's official and lawful duty

(3) Part IV, Section §1-5 of the Criminal Code Act shall be amended as follows:
1 - Assault
Offence Type: Summary
Penalty: 1 Penalty Unit; 5 minutes imprisonment
A person commits an offence if the person:
(a) intentionally hits another player, causing a loss of no more than 3 hearts; or
(a) intentionally causes another player to lose no more than 3 hearts; or
(b) places another player in a position of danger, including but not limited to pointing a weapon at them.

2 - Attempted Murder
Offence Type: Summary
Penalty: 13 Penalty Units; 10 minutes imprisonment
A person commits an offence if the person:
(a) intentionally hits another player, causing a loss of more than 3 hearts.; or
(a) intentionally causes another player to lose more than 3 hearts; or
(b) verbally threatens another player's life and attacks them.

3 - Murder
Offence Type: Summary
Penalty: 3.54 Penalty Units; 15 minutes imprisonment
A person commits an offence if the person:
(a) unlawfully kills another player.

4 - Mass Murder
Offence Type: Summary
Penalty: 6 Penalty Units per murder; 20 minutes imprisonment per murder; Additionally, if a firearm was used:
(a) 9 or fewer unlawful killings: 1 firearms license strike
(b) 10+ unlawful killings: 1 firearms license strike, plus an additional license strike for every 10 unlawful killings.
A person commits an offence if the person:
(a) unlawfully kills five or more players before being apprehended.
(i) This offense shall override Murder.

5 - Massacre
Offense Type: Summary
Penalty: 10 Penalty Units per murder; 25 minutes imprisonment per murder; Additionally, if a firearm was used:
(a) 25 unlawful killings: 5 firearms license strikes.
(b) 25+ unlawful killings: 5 firearms license strikes, plus an additional license strike for every 5 unlawful killings.
A person commits an offence if the person:
(a) unlawfully kills twenty-five or more players before being apprehended.
(i) This offense shall override Mass Murder.

(4) Part IV, Section §8 of the Criminal Code Act shall be amended as follows:
8 - Assault of Protected Entity
Offence Type: Summary
Penalty: 1 Penalty Unit; 5 minutes imprisonment
A person commits an offence if the person:
(a) intentionally hits damages an animal owned by another player without consent; or
(b) intentionally hits damages an animal in the care of a shelter.
Relevant Law:

(5) Part IV, Section §12 of the Criminal Code Act shall be amended as follows:
12 - Unauthorised Firearms Sales
Offence Type: Indictable Summary
Penalty: Confiscation of unlicensed firearms; Additionally:
(a) First offence: Up to 50 Penalty Units; Up to 30 minutes imprisonment 10 Penalty Units; 5 minutes imprisonment; 2 firearms license strikes
(b) Subsequent offences: Up to 100 Penalty Units; Up to 60 minutes imprisonment 20 Penalty Units; 10 minutes imprisonment; 3 firearms license strikes
A person commits an offence if the person:
(a) sells, distributes, or traffics a firearm:
(i) for which the recipient of the item lacks the proper licensure to handle; or
(ii) for which the offender lacks the proper licensure to handle.

(6) Part IV, Section §14 of the Criminal Code Act shall be enumerated as:
14 - Tool Abuse
Offence Type: Summary
Penalty: 10 Penalty Units; 15 minutes imprisonment; confiscation of the tool
A person commits an offence if the person:
(a) abuses government exclusive tools against another player
This offense shall not occur when:
(i) The use of the tool was allowed under law or department policy.


(7) Part V, Sections §4-5 of the Criminal Code Act shall be amended as follows:
4 - Threats
Offence Type: Summary
Penalty: 1 Penalty Unit
(a) First offense - 1 Penalty Unit
(b) Second offense - 2 Penalty Units
(c) Subsequent offenses - 3 Penalty Units; 5 minutes imprisonment
A person commits an offence if the person:
(a) verbally threatens another player with communication to cause fear or force action.

5 - Public Nuisance
Offence Type: Summary
Penalty:
(a) First offence: Imprisonment for duration of event not exceeding 1 hour; 15 Penalty units.
(b) Second offence: Imprisonment for duration of event not exceeding 1 hour; 30 Penalty Units
(c) Subsequent offences: Imprisonment for duration of event not exceeding 1 hour; 45 Penalty Units
(a) First offence - 15 Penalty Units; Imprisonment for duration of event not exceeding 1 hour, or, if the event has ended, 15 minutes imprisonment
(b) Second offence - 30 Penalty Units; Imprisonment for duration of event not exceeding 1 hour, or, if the event has ended, 30 minutes imprisonment
(c) Subsequent offences - 45 Penalty Units; Imprisonment for duration of event not exceeding 1 hour, or, if the event has ended, 45 minutes imprisonment
A person commits an offence if the person:
(a) willfully disrupts or trolls DPA-sanctioned or government events, or political rallies; or
(b) interferes with planning or execution of such events.

(8) Part V, Section §7 of the Criminal Code Act shall be amended as follows:
7 - Careless Operation of Vehicles
Offence Type: Summary
Penalty: 1 Penalty Unit
(a) First offense - 1 Penalty Unit
(b) Subsequent offense - 3 Penalty Units; 5 minutes imprisonment
A person commits an offence if the person:
(a) operates a vehicle off-road, on sidewalks, or otherwise improperly; or
(b) blocks traffic, operates a vehicle on the wrong side, or endangers others; or
(c) while under the influence (≥25% BAC):
(i) operates a vehicle; or
(ii) operates an aircraft.

(9) Part VI, Section §3 of the Criminal Code Act shall be amended as follows:
3 - Illicit Substance Trafficking
Offence Type: Indictable Summary
Penalty:
(a) Class 1 Buff - Up to 250 Penalty Units; up to 60 minutes imprisonment; Seizure of illicit items.
(b) Class 2 Buff - Up to 100 Penalty Units; up to 60 minutes imprisonment; Seizure of illicit items.
(c) Buff Components - Up to 100 Penalty Units; up to 60 minutes imprisonment; Seizure of illicit items.
(d) Buff Seeds - Up to 100 Penalty Units; up to 60 minutes imprisonment; Seizure of illicit items.
(e) Weaponized Buffs - Up to 250 Penalty Units; up to 60 minutes imprisonment; Seizure of illicit items.
(f) Shine Elixir - Up to 100 Penalty Units; up to 60 minutes imprisonment; Seizure of illicit items.
A person commits an offence if the person:
(a) sells, distributes, or traffics any quantity of an illicit substance.
(b) brings illicit substances into Redmont with the intention of selling.

(10) Part VI, Section §7 of the Criminal Code Act shall be amended as follows:
7 - Weapon of Mass Destruction Trafficking
Offence Type: Indictable Summary
Penalty: Up to 100 Penalty Units; Up to 60 minutes imprisonment
(a) First offence - 10 Penalty Units; 10 minutes imprisonment
(b) Second offence - 20 Penalty Units; 15 minutes imprisonment
(c) Subsequent offence - 30 Penalty Units; 30 minutes imprisonment
A person commits an offence if the person:
(a) sells or traffics a weapon of mass destruction; or
(b) distributes a Weapon of Mass Destruction.
Instance (b) of this offence shall not occur where:
(a) the person holds a valid Enhanced firearms license; and
(b) the possession is done with the permission of the DHS Secretary; and
(c) the possession is done in the course of the person’s official duties as a member of the DHS.

(11) Part VIII, Section §1 of the Criminal Code Act shall be amended as follows:
1 - Trespass
Offence Type: Summary
Penalty:
(a) First offence - 3 Penalty Units
(b) Second offence - 5 Penalty Units; 5 minutes imprisonment
(c) Third offence - 7 Penalty Units; 10 minutes imprisonment
(d) Subsequent offences - 10 Penalty Units; 10 minutes imprisonment
A person commits an offence if the person:
(a) enters an area that has been restricted to public access via a no trespassing sign, book, or another form of communication visible from every entrance
(i) to have this offence be proven, a government employee must use the /inspect command to ensure no edits had occurred afterwards.
(a) enters an area that has been restricted to public access via locked doors, barriers or other obstructions; or
(b) enters an area that has been restricted to public access via a no trespassing sign, written notice, or any other form of communication visible from every entrance; or
(i) If there is any doubt as to the existence of such communication at the time of the offence, a government employee must have used the /inspect command to verify that no edits have been made to it.
(c) enters any restricted government property such as but not limited to Revcatraz; or
(d) has failed to leave the property after being requested to leave by the owner, a lawful resident or added member of the property.
(i) For the purposes of this section, an added member shall also include any person who is lawfully employed or otherwise authorized to manage or operate the property.
This offense shall not occur when:
(a) a government employee is acting in their official capacity when authorized by law.

(12) Part VII, Section §6 of the Criminal Code Act shall be amended as follows:
6 - Embezzlement
Offence Type: Indictable
Penalty: Up to 200 Penalty Units; 10Up to 60 minutes imprisonment
A person commits an offence if the person:
(a) fraudulently and knowingly misappropriates assets that have been entrusted to them, or have lawfully come into their possession by virtue of office, employment, or position of trust.

(13) Part VIII, Section §5 of the Criminal Code Act shall be amended as follows:
5 - ATM Robbery
Offence Type: Summary
Penalty: 2 Penalty Units; 5 minutes imprisonment
(a) First offence - 2 Penalty Units; 5 minutes imprisonment
(b) Second offence - 3 Penalty Units; 5 minutes imprisonment
(c) Subsequent offences - 5 Penalty Units; 10 minutes imprisonment
A person commits an offence if the person:
(a) steals, attempts to steal, or attempts to hack money from an Automated Teller Machine (ATM).
Relevant Law:

(14) Part VIII, Section §8 of the Criminal Code Act shall be amended as follows:
8 - NPC Robbery
Offence Type: Summary
Penalty: 1 Penalty Unit
(a) First offence - 1 Penalty Unit
(b) Second offence - 2 Penalty Units
(c) Subsequent offences - 3 Penalty Units; 5 minutes imprisonment
A person commits an offence if the person:
(a) steals or attempts to steal money from a Non-Player Character (NPC).
Relevant Law:

(15) Part X, Section §7 of the Criminal Code Act shall be amended as follows:
7 - Illegal Advertising
Offence Type: Summary
Penalty:
(a) First Offence - 5 Penalty Units.
(b) Second Offence - 10 Penalty Units.
(c) Subsequent Offences - 25 Penalty Units.
A person commits an offence if the person:
(a) advertises a business, goods, service, or a political campaign in: a public chat not designated for advertising; or
(i) a public chat not designated for advertising; or
(ii) an unsolicited DM, either in-game or through an external messaging app,
(b) advertises a gaming institution or gambling in a public chat designated for advertising.
(b) advertises an illicit service, item, or other form of transaction that is deemed criminal by this act. or the Redmont Civil Code Act.
(i) This offence shall not occur when it is advertising specifically for a BM's (Black Market's) services in a proper channel.

(16) Part X, Section §13 of the Criminal Code Act shall be amended as follows:
13 - Operating Without A License
Offence Type: Summary
Penalty: 1 Penalty Unit
(a) First offence - 1 Penalty Unit;
(b) Second offence - 3 Penalty Units; 5 minutes imprisonment
(c) Subsequent offence - 5 Penalty Units; 10 minutes imprisonment
A person commits an offence if the person:
(a) drives a car without a Drivers License, or
(b) pilots a plane or helicopter without a Pilots License.

4. Amendments to the Jail Activities Act
(1) Section §3(2) of the Jail Activities Act is to be amended as follows:

(2) Ores and blocks mined in the mine shall be traded to the government in exchange for less jail time:

1 piece of cobblestone: Takes away 1 seconds
1 piece of coal: Takes away 3 seconds
1 piece of raw iron: Takes away 85 seconds
1 piece of raw gold: Takes away 97 seconds
1 piece of diamond: Takes away 1210 seconds

5. Amendments to the Redmont Civil Code Act
(1) Part XII, Section §7-8 of the Redmont Civil Code Act shall be amended as follows:
7. Academic Misconduct
Violation Type: Administrative
Remedy:
(a) First violation - Up to 1 Civil Penalty Units;
(a) Subsequent violation - Up to 5 Civil Penalty Units; suspension from relevant qualifications;
A person commits a violation if the person:
(a) solicits answers to DOE-administered exam questions.
This violation shall not occur where:
(b) the person has already been found liable for Breach of Academic Integrity for the same conduct.

8. Breach of Academic Integrity
Violation Type: Administrative
Remedy: Up to 20 Civil Penalty Units; suspension from relevant qualifications;
A person commits a violation if the person:
(a) gives or sells answers to DOE-admnistered exam questions; or
(a) attempts or successfully gives or sells answers to DOE-administered exam questions; or
(i) This includes advertising the sale of exam questions.
(b) purchases or openly receives cheated DOE-administered exam answers and intends to, or does, use them in a DOE-administered examand uses them in a DOE-administered exam.

(2) Part XII, Section §10 of the Redmont Civil Code Act shall be amended as follows:
10. Frivolous Government Application
Violation Type: Administrative
Remedy: Up to 5 Civil Penalty Units
A person commits a violation if the person:
(a) creates a government job or expression of interest application without genuine intent.; or
(b) declares for a government election while failing to meet multiple requirements
This offense shall not occur where:
(c) the application was accepted or permitted by policy or statute.

PART III - STRIKE BILLS

1. Provisional Debt Recovery Act
(1) The following shall be enumerated as Part VII, Section §40 of the Criminal Code Act:

40 - Falsely Claiming Debt Recovery
Offence Type: Summary
Penalty: Up to 50 Penalty Units
A person commits an offence if the person:
(a) knowingly makes a false claim for debt recovery under the Provisional Debt Recovery Act.

2. Gambling Regulation (Games of Skill) Amendment Act
(1) The following shall be enumerated as Part X, Section §8 of the Criminal Code Act:

8 - Illegal Gaming Advertising
Offence Type: Summary
Penalty: 25 Penalty Units; 10 minutes imprisonment
A person commits an offence if the person:
(a) advertises a gaming institution or gambling in a public chat designated for advertising; or
(b) sends an unsolicited DM, either in-game, or through an external messaging app such as Discord or the DemocracyCraft Forums advertising a gaming institution or gambling; or
(c) drops items directing a player to a gaming institution or gambling.

3. Property Lien Act
(1) The following shall be enumerated as Part VII, Section §41-43 of the Criminal Code Act:

41 - False Lien Filing
Offence Type: Indictable
Penalty: Up to 300 Penalty Units; up to 30 minutes imprisonment; cancellation of the false filing
A person commits an offence if the person:
(a) knowingly files a Lien in the Lien Registry, or accepts or causes acceptance of an SIH Agent invitation, that does not arise under the Property Lien Act; or
(b) knowingly perfects a Lien for an amount materially greater than is owed; or
(c) knowingly perfects a Lien against property in which the Lien Debtor has no interest, with intent to harass or defraud.

42 - Failure to Release a Satisfied Lien
Offence Type: Summary
Penalty: Up to 100 Penalty Units; restitution of any damage caused
A person commits an offence if the person:
(a) being a Lienholder, fails to file a Release of Lien or release the relevant SIH Agent within 14 days of the secured obligation being satisfied; and
(b) the failure is willful or in reckless disregard of the Lien Debtor's interests.

43 - Illegal Private Foreclosure
Offence Type: Indictable
Penalty: Up to 200 Penalty Units; up to 30 minutes imprisonment; restitution of Fair Market Value of the Collateral
A person commits an offence if the person:
(a) seizes, sells, or otherwise disposes of Collateral subject to a Lien without following the foreclosure procedures of the Property Lien Act and without an order of the Federal Court.

4. Renumbering
(1) All subsequent sections and subsections of the Criminal Code Act shall be renumbered as appropriate.
