COMPLAINT
The Plaintiff complains against the Defendant as follows:

On March 29th, 2024, the Defendant, 5axe, made defamatory remarks against Blue Diamond Casino in the Minecraft chat. Following the Plaintiff's business advertisement using the "/ad" command, the Defendant posted a comment in the chat stating "they are bad and rigged" while pointing at the Plaintiff's ad.

II. FACTS

1. On March 29th, 2024, Unseatedduke1, the proprietor of Blue Diamond Casino, utilized the "/ad" command to promote Blue Diamond in the Minecraft chat.

2. Following the publication of the advertisement, the defendant, in the presence of 30 online players, made the defamatory remark "they are bad and rigged” in reference to Blue Diamond Casino (Exhibit A and B).

3. It is evident that the defendant engaged in slanderous behavior against Blue Diamond Casino stating it was "rigged".

III. CLAIMS FOR RELIEF

1. In accordance with the Defamation Act of October 2020, slander is defined as a false statement that detrimentally affects one's reputation within the context of Minecraft, encompassing both in-game text within the server's General Chat and spoken communication in Discord chats.

2. The defamatory remarks made by the defendants tarnished the esteemed name and reputation of Blue Diamond Casino, resulting in the loss of potential business from 30 players who were actively online and could witness the statement in real-time. It's important to note that this figure does not account for additional players who may have access to Minecraft chats via Discord.

3. The defendants' statements were a deliberate assault on the casino aimed at diverting business away from Blue Diamond. This malicious attack not only seeks to besmirch the reputation of the plaintiff's establishment but also imposes an increased marketing burden on the plaintiff to counteract the detrimental effects of these messages on business operations.


IV. PRAYER FOR RELIEF
The Plaintiff seeks the following from the Defendant:

1. Blue Diamond Casino demands a written apology from 5axe.

2. Pursuant to the Defamation Act of October 2020, damages for defamation are applicable. Therefore, we seek $150,000 in damages. This number is based on the number of players who could view the statement at the time at $5,000 a player.

3. Legal Fees: Considering the time and effort I am expanding in addressing the defamation caused by the Defendant, I request reimbursement of 20% of the case's total value.

By making this submission, I agree I understand the penalties of lying in court and the fact that I am subject to perjury should I knowingly make a false statement in court.

MOTION TO DISMISS

The defence move that the complaint in this case be dismissed, and in support thereof, respectfully alleges:

1. 5axe is a brand new player on the server who joined yesterday, March 29th, 2023, and was not aware of the consequences of his actions. We urge to court to consider that 5axe is brand new and still learning about the rules and laws of the server and suing 5axe for such a large amount over a little statement is ridiculous. (Exhibit A)

2. The plaintiff fails to state which type of damage he is suing for. "damages for defamation" - (Plaintiff), are not in the Legal Damages Act.

Blue Diamond Casino has reached a settlement with the opposing party outside of this courtroom and seeks to withdraw this lawsuit.
 
Case dismissed at the request of the plaintiff.
