Amend the by-laws of Aventura​

The citizens of Aventura, through their elected Representatives in the Town-Council and the force of law ordained to that Town-Council by the people through the constitution of Aventura, do hereby enact the following provisions into the by-laws:

1 - Short Title and Enactment
(1) This Act may be cited as the 'Better By-laws Act.'
(2) This Act shall be enacted immediately upon its signage.
(3) This Act has been authored by: Councillor RealImza
(4) This Act has been co-sponsored by: Mayor AnimeInc

2 - Reasons
1. Following the passage of the new constitution, many of the by-laws are outdated and use incorrect terminology.
2. Following the passage of the Aventura Property Regulations Act, many by-laws were repealed; however, they are yet to be removed.

3 - Amendment
(1) The color red shall mean the removal of the colored text.
(2) The color green shall mean the addition of the colored text.
(3) All other colors shall be left as is, or added in if not previously there.

General

The Laws and Decrees pertaining to the Township of Aventura hereby declare in this Bylaw dubbed “The Resident Requirement Act” that:

  • In order for a citizen to be a resident of the Town, they must set their in-game residency to Aventura. They must meet one of the following criteria:
    • They must hold residential land within the town.
      • This requirement is needed in order to participate in elections & events hosted on the forums.

The Laws and Decrees pertaining to the Township of Aventura hereby declare in this Bylaw dubbed “Eminent Domain Act” that:

  • The constitution of Aventura specifically grants the Office of Urban Development the right to evict anyone from their plot.
    • To abide by the Right XIV of the Redmont Constitution, the Township of Aventura will offer fair compensation to plot owners whose plots are being repossessed by eminent domain.
    • Residents have the right to negotiate with the Township of Aventura the price of their plot.
    • Refusing the deal will result in the Office of Legal Affairs the Chief Counsel requesting authorization for Eminent Domain from the Federal Redmont Courts.
    • If the Courts do not allow for the town to use Eminent Domain, the case shall be referred to the Attorney General, and federal Eminent Domain will be used against the plot.

The Laws and Decrees pertaining to the Township of Aventura hereby declare in this Bylaw dubbed “The Plot Limit Act” that:

  • All Residents and Non-residents are only allowed to own one plot of each type. In order to own more than one plot of each type, permission must be granted by the Town Council.

The Laws and Decrees pertaining to the Township of Aventura hereby declare in this Bylaw dubbed “The Public Opinion” that:
  • Should a bill that has been proposed by a resident receive 5 citizen's signatures, it shall be proposed directly to the Aventura Council forum thread #bill-proposals, and voting on it will begin immediately.
The Laws and Decrees pertaining to the Township of Aventura hereby declare in this Bylaw dubbed “The Subletting Permissions Act” that:
  • The constitution of Aventura specifically grants the Office of Urban Development responsibility for the maintenance of current plots. That should include the oversight over regioning in commercial plots.
    • This bylaw declares the act of creating rent regions in rented or owned plots without permission from the Office of Urban Development as illegal with the following punishments
      • 1st offense: Verbal Warning
      • 2nd offense: Eviction
      • Shulker box placement regions are permitted.
The Laws and Decrees pertaining to the Township of Aventura hereby declare in this Bylaw dubbed “The Exterior Act” that:
  • The constitution of Aventura specifically grants the Office of Urban Development responsibility for the maintenance of current plots
    • Thus this Bylaw declares the act of modifying the exterior of any prebuilt structure in Aventura without permission from the Office of Urban Development as Illegal with the following punishments:
      • Per Offense: Eviction
    • Modifications are permitted in the interior so long as the tenant restores it to its original state at the end of the lease/before reselling the property.
Residential

The Laws and Decrees pertaining to the Township of Aventura hereby declare in this Bylaw dubbed “The Residential No Commerce Act” that:

  • The operating of a business, through the use of a chest shop or otherwise, in a residential plot, is not permitted.
    • First Offense: Verbal Warning
    • Second Offense: Eviction

The Laws and Decrees pertaining to the Town of Aventura hereby declare in this Bylaw dubbed “Aventura Property Regulations Act” that:
  • The Department of Construction and Transportation shall retain jurisdiction to evict properties in accordance with these laws and regulations. These regulations will be listed under the Town of Aventura forums page.
  • The Office of Urban Development may create property and building regulations outside of this Act, if not overridden by an Act of Council.
  • The Town Council, by a unanimous vote, with approval from the Mayor, has the power to issue and revoke exemptions and extensions for building regulation and legal compliance. The Office of Urban Development shall record exemptions and shall communicate them with the Department of Construction and Transportation.
  • Every Captain must go down with their ship.
    • First Offense, Minor Alteration: $200 Fine + Repair Costs + Verbal Warning
    • Second Offense, Major Alteration: $800 Fine + Repair Costs + Verbal Warning
    • Third Offense, Demolished Building: $2200 Fine + Repair Costs + Verbal Warning
    • Subsequent Offenses: Plot Eviction
  • All property regulations shall be listed on the Aventura Building Regulations Page.

Commercial

The Laws and Decrees pertaining to the Township of Aventura hereby declare in this Bylaw dubbed “The Aventura Taxation Act” that:

  • The Constitution of Aventura specifically grants the Office of Commerce the power of taxation with approval from the Town Council.
    • Therefore, all taxes will be controlled through this act. Any changes to the Tax System will come about because of an edit to this Bylaw.
    • All taxes must be paid by residents and non-residents of Aventura.
    • The Current Taxes for the town of Aventura:
      • $0 Corporate Flat Tax
      • $0 Property Tax
      • 0% Property Sales Tax
      • $0 Yacht Tax
    • Taxes shall be collected by the Office of Commerce. Notice shall be sent to Residents and Non-Residents about the tax owed. Residents must provide proof that they have sent their owed tax to the Office of Commerce
    • It shall be illegal to evade taxes in Aventura. As this is an internal town matter, the Office of Legal Affairs the Chief Counsel will prosecute those who purposely evade taxes.
      • Per Offense: “$100 fine + Taxes Evaded fined”
      • Repeat Offenders who are non-residents may be barred from renting in Aventura for a period no greater than one week.
      • Repeat Offenders who own land in Aventura may have their plots repossessed and face the loss of their residency.
    • Residents and Non-Residents who can show proof of never receiving a notice of tax do not have to pay tax. However they will be required to pay back taxes on the missed tax.

The Laws and Decrees pertaining to the Township of Aventura hereby declare in this Bylaw dubbed “The Market Stall Act” that:

  • It shall be illegal to own more than four (4) market stalls. People who own more than four shall have all additional stalls removed from their possession. In order to own more than four stalls, permission must be granted by the Town Council.

Boats

The Laws and Decrees pertaining to the Township of Aventura hereby declare in this Bylaw dubbed “The I’m The Captain Now Act” that:


  • Every Captain must go down with their ship.

The Laws and Decrees pertaining to the Township of Aventura hereby declare in this Bylaw dubbed “The Boat Renting Limitation Act” that:

It shall be illegal to rent/hold/own more than one (1) "ab plot" (boat) at a time. If a resident is found doing so, one of the "ab plots" will be removed from their possession. In order to own more than one boat, permission must be granted by the Town Council

Legal

The Laws and Decrees pertaining to the Township of Aventura hereby declare in this Bylaw dubbed “District Attorney Act” that:

  • The Constitution of Aventura specifically grants the Office of Legal Affairs the Chief Counsel the power of prosecution within the Township of Aventura.
    • The Head of Legal Affairs Chief Counsel will hold the title of District Attorney when acting as the prosecuting authority of Aventura.
    • The Office of Legal Affairs Chief Counsel, at the discretion of the Head of Legal Affairs Chief Counsel, can hire Attorneys to act as prosecuting authorities for the Town of Aventura under the title of “Assistant District Attorney”.
    • Payment for cases will be a flat-rate commission specified by the Head of Legal Affairs Chief Counsel.
      • For particularly complex cases, a further amount may be awarded at the discretion of the Head of Legal Affairs Chief Counsel.
      • Funding will be issued from the Town of Aventura Treasury.
    • The hiring process for Assistant District Attorneys shall be handled by the Head of Legal Affairs Chief Counsel.
    • All Assistant District Attorneys will have “at-will” employment at the discretion of the Head of Legal Affairs Chief Counsel.

Legislative

The Laws and Decrees pertaining to the Town of Aventura hereby declare in this Bylaw dubbed “Aventura Legislative Motions Standard Act” that:
  • Motion of Removal:
    • A member of the council may propose a Motion of Removal to remove the Mayor, Deputy Mayor, or another Councillor from their office for any reason the council deems necessary. If passed, the office of the target shall be declared vacant, and the constitutionally mandated steps shall be taken to fill the office once more.
    • To pass, the Concurrence of a supermajority (3/4) of all sitting council members, excluding those with a conflict of interest, is required.
  • Motion of Censure:
    • A member of the council may propose a motion of censure to condemn the actions of any individual. A censure shall not impose penalties but shall serve as a formal reprimand.
    • To pass, the Concurrence of a simple majority of all sitting council members, excluding those with a conflict of interest, is required.
  • Motion to Amend:
    • A member of the council may propose a motion to amend to a bill that is undergoing the legislative process. A motion to amend may not be filed if a bill has already passed. If passed, the legislative process for the bill, including all previous votes, shall be reset.
    • To pass, the concurrence of the same majority required for passage of the amended bill in the council is required.
  • Motion to Override Veto:
    • A member of the council may propose a motion to override veto to override a veto used by the Mayor.
    • To pass, the concurrence of a supermajority (2/3rds) of all sitting council members, excluding those with a conflict of interest, is required.
  • Motion Procedures:
    • If a councillor wishes to propose a motion, they shall be required to post it in the “#council-floor” channel.
    • The Mayor, or if delegated to, the Deputy Mayor, shall be required to post the motion in the “#council-voting” channel.
    • The Mayor, or if delegated to the Deputy Mayor, shall be required to create a thread under the motion.
