Create bail In Redmont

The people of Democracy Craft, through their elected representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as the “Bill Initiation Act”.
(2) This Act shall be enacted immediately upon its signage.
(3) The Act has been co-sponsored by: FracturedGhast7 and Sen. Antatro

2 - Reasons
  1. To help create an environment of peaceful and complying citizen arrests on our server. Many players often try to escape being arrested as they see that there is no other option or alternative as they don’t want to spend or waste 10 minutes of their own time. This makes for less peaceful arrests and wastes the time of our police officers who would rather not spend their whole time chasing criminals all day. A bail policy like the on in this bill could help to change this
  2. To help and expand current budgets in our government especially in the DOJ and fix any deficits in our government especially that of which pertaining to the DOJ.
  3. To create a far more immersive roleplay experience for the players in our server pertaining to that matter of being jailed and arrested.
3- Enforcement
  1. If player commits a crime, the police, will begin the process of arresting the player charged with committing the crime. Upon the instance the player is arrested and managed to not be charged with resisting/escaping arrest the player or any willing party has the choice to pay bail.
    1. The moment a police officer begins to pursue a player they must tell them to comply and meet with the police officer if they want the possibility to pay bail.
    2. The cops must warn the player that if they choose to continue to resist arrest they lose the possibility of bail
  2. Once the player has been apprehended, they will be told their bail amount. The arresting officer will then post the bail amount to be paid in global chat in this format: <name> <crime>, bail set at <amount>
    1. That amount is equal to double the jail fine for that crime.
  3. The player or other willing consented parties can choose to pay the bail then.
    1. In the instance, the player enters jail and then later seeks to choose the option of bail he may be allowed to open a DOJ ticket to seek for his bail for only the first half of his jail time.
      1. At this point, any willing party may pay bail for the player also.
  4. The jailed player or another willing player can choose to pay that amount.
  5. If they do so, the DOJ will fine the paying player.
  6. Upon doing so the jailed player will then be released.

4 - Bail Limitations:
  1. If the police charge the arrested player with escaping arrest, the arrested player and other willing consented parties lose the ability to pay bail.
  2. Bails will not be allowed for the following crimes;
    1. Public Nuisance, Contempt of Court, Contempt of Congress, Police Misconduct, National Park, Perjury, Bank Robbery, Market Allocation, Monopolization, charges with more than 6 murder.
  3. Bails can only be paid/fined for the first half of jail time.
  4. Other players can pay bails for jailed players however the jailed players must give consent.
  5. All bail must be logged by the DOJ.
  6. Paying with bail will not erase any crimes on your criminal record
  7. No police officer is allowed to bail out another player but themself.
  8. The paying person/party can’t have a negative balance.
  9. In situations, of mass emergency or any situation where there is a need to for all cops to respond to a situation. It will be up to the discretion of the DOJ for all arrests arising of that situation on whether or not the crime will be bailable.
  10. The DEC has the full authority to audit bail money, however the DOJ will maintain all bail profits within their 3/4 of the bail distribution as listed in article 5.
  11. Persons whom ask for 2 bails within 20 minutes of each other may not be granted the second bail
  12. Any attempt to not sue over a denied bail will count as an Frivolous Court Case

5- Distribution
  1. For all matters dealing with the monetary accounts of the bail program, it will be distributed as such:
    1. Three quarters of all bail money must be apportioned to the DOJ and the matters of such account will be up to the members of the DOJ and its secretary.
      1. As stated in Article 4, section 2, the DEC will have the right to audit bail money, but it will have no right to cut into the DOJ’s 75% share of the bail money.
    2. The remaining quarter will be put into the DCgovernment account.

This bill has been vetoed with the consent of the Vice President and some members of cabinet for the following reasons:

- It's not practical. As you can see, the house was very split on this vote and I've spoken to many Representatives who said this very thing, bail just isn't practical on this server.
- It's overly complicated. There are too many variables present in this bill, so many different aspects that just don't make it worth while.
- The government doesn't need bail money, the government balance has been on the rise for the past 2 months and is only continuing to grow.
- Jail times are low on purpose so that people don't have to wait overly long but still have to face a punishment.

I acknowledge there was a lot of work put into whipping votes for this bill, I applaud Representative Awesam for working to get this passed but the grounds it was passed on is shaky in it of itself. I've spoken to some of the Representatives & Senators who voted aye on this and they were largely on the fence to begin with. Perhaps in the future this can be revisited but as for now, it's a veto.

Also, is how close or not close a bill is voted somehow a measure of its practicality? If the question be that bail isn't practical or that it can't be implemented, the bill shows how it can be implemented and with a willing police-force that can enforce. How is therefore unpractical, or hard to implement? Yes, the newer players and in the first few weeks there are going to be growing pains but once the bill actually gets implemented the vast majority of players will know how to act and will bail will become more easily to implement.. and therefore it will become practical.

The only 2 main variables in this bill is that you need to comply with the police and that if someone else bails you out, you need to say ok to it. Thats the only main variable everything else is stated to to avoid inferences, such as "All bail must be logged by the DOJ", "No police officer is allowed to bail out another player but themself", "The paying person/party can’t have a negative balance". All of these are stated to avoid inferences.

Because people don't want to spend time in jail, you may think it's short, but can that opinion be said for everyone? And this bail bill doesn't change that you committed the crime, it only changes the fact that the punishment is monetary.
-Also, did you speak to the DOJ about this bill consider that this bill primarily concerns the DOJ?
