To
Establish Standing Orders for the 3nd Council of Aventura
ENACTED by the Council of Aventura on the 26th of April, 2026
---
I. Legislative Process
Proposal of Bills:
(a) Any Councillor may propose a Bill.
(i) This Bill shall be posted within the Aventura Council forum.
(ii) This Bill shall follow the format for Bills as provided by the Speaker.
(iii) This Bill shall have at least one sponsor.
(iv) Additional individuals may sponsor a Bill.
(b) The posting sponsor may inform the Speaker of their intent to table the Bill.
(i) This must occur within the channel "#council-floor".
(c) Once the Speaker has been informed of the posting sponsor's intent to table a bill, they shall put the Bill up for voting within 24 hours of the request.
(i) Voting shall happen within the #council-voting channel, within a thread.
(ii) The Speaker of the Council shall create this thread.
(iii) This thread shall be named following this format: “[Name of Bill]”
(iv) Councillors may vote:
- In Favour of a Bill;
- Against a Bill;
- Abstain on a Bill.
(d) After 24 hours, or if the required majority and quorum have been reached:
(i) If passed, the Bill shall be presented to the Mayor for Assent or Veto. If assented to, it shall be moved to the Acts of Council forum and tagged “Act of Council”.
(ii) If failed, it shall be moved to the Archive forum and tagged “Bill: Rejected”.
Proposal of Motions:
(a) Any Councillor may move for a motion.
(i) This Motion shall be posted within the “#council-floor” channel.
(ii) This Motion shall follow the format for Motions as provided by the Speaker.
(b) The Speaker shall put the Motion up for voting within 24 hours.
(i) Voting shall happen within the "#council-voting" channel, inside a thread.
(ii) The Speaker shall create this thread.
(iii) This thread shall be named: “AC.[2].[3]”
(iv) Councillors may vote:
- In Favour;
- Against;
- Abstain.
(v) Any Councillor with a Conflict of Interest shall not vote.
(vi) Exception — Appeals:
A Councillor with a Conflict of Interest may vote on procedural appeals where their participation is required to:
- achieve quorum; or
- break or prevent a tied vote.
(vii) The applicability of this exception shall be determined automatically based on the number of eligible voting Councillors at the time of the vote, and shall not be subject to the discretion of the Speaker.
(viii) Where there is disagreement regarding eligibility, the Council shall decide the matter immediately by a simple majority vote, without debate.
(c) After 24 hours, or once majority and quorum are reached:
(i) If passed, the Motion shall pass.
(ii) If failed or quorum not met, it shall fail.
Alternative Voting Methods and Proxy Voting
(a) Alternative Voting:
(i) Councillors may submit votes via written communication to the Speaker.
(ii) The Speaker shall record and label such votes.
(iii) These votes hold equal validity.
(b) Proxy Voting:
(i) A Councillor may designate another Councillor as proxy.
(ii) Written authorization must be provided to the Speaker.
(iii) Proxy remains until revoked or the proxy holder ceases to be a Councillor.
(iv) Proxy may be revoked at any time in writing.
(v) Proxy holder must indicate proxy voting.
(vi) The Speaker shall maintain a public proxy record.
(c) Limitations:
(i) A Councillor may not hold more than one proxy.
(ii) Proxy voting is not allowed where there is a conflict of interest.
(iii) Direct votes override proxy votes.

II. The Speaker
Maintaining Order:
(a) The Speaker may order the temporary removal of any person for clearly defined disruptive behaviour, including repeated interruptions, refusal to follow rulings, or abusive conduct.
(b) A warning must be issued prior to removal unless behaviour is egregious.
(c) Removal shall be temporary and limited to the session.
(d) Any Councillor removed may appeal the decision immediately, and the Council may overturn the removal by a simple majority vote.
(e) The Sergeant-at-Arms shall execute removal orders.
Authority Over Procedure:
(a) The Speaker shall enforce parliamentary procedure impartially.
(b) Where ambiguity exists, the Speaker’s interpretation shall prevail unless overturned by a simple majority vote of Council.
(c) The Speaker may set procedural precedents.
(i) Councillors must follow precedents.
(ii) Council may override precedents by simple majority.
(iii) Future Speakers may overturn prior precedents.
(d) The Speaker may issue warrants to compel attendance, provided such warrants may be overturned by a majority vote of Council.
Election of the Speaker:
(a) Upon vacancy, the Clerk shall begin the election.
(b) Nominations last 24 hours.
(i) The Mayor shall open nominations in "#council-floor".
(ii) Councillors may nominate themselves or others.
(c) Voting follows nominations.
(i) Voting lasts 24 hours or until a candidate reaches majority.
(ii) A sole nominee becomes Speaker automatically.
(iii) The candidate with majority becomes Speaker.
Term of the Speaker:
(a) The Speaker serves during good behaviour and until:
(i) Resignation;
(ii) Removal via Vote of No Confidence;
(iii) End of Council term.
(b) “Good behaviour” means performing duties impartially and in accordance with these Standing Orders.
(c) Removal shall only occur through a formal Vote of No Confidence passed by a simple majority.
Clerk of the Council:
(a) The Clerk serves as senior assistant to the Speaker.
(i) Advises on procedure;
(ii) May receive delegated powers.
(b) The Clerk is nominated by the Speaker and confirmed by majority vote.
(c) The Clerk may be removed by a majority vote of Council.
(d) The Clerk must receive notice of any removal motion and an opportunity to respond before the vote.
