Establish Legislative Standards for Motions​

The citizens of Aventura, through their elected Representatives in the Town-Council and the force of law ordained to that Town-Council by the people through the constitution of Aventura, do hereby enact the following provisions into the by-laws:

1 - Short Title and Enactment
(1) This Act may be cited as the 'Aventura Legislative Motions Standard Act.'
(2) This Act shall be enacted immediately upon its signage.
(3) This Act has been authored by: Councillor RealImza
(4) This Act has been co-sponsored by: Councillor Plura72

2 - Reasons
(1) To establish proper legislative standards for motions.
(2) To grant the council greater powers and abilities to represent their constituents.

3 - Motion Types
(1) Motion of Removal
(a) A member of the council may propose a Motion of Removal to remove the Mayor, Deputy Mayor, or another Councillor from their office for any reason the council deems necessary. If passed, the office of the target shall be declared vacant, and the constitutionally mandated steps shall be taken to fill the office once more.
(b) To pass, the Concurrence of a supermajority (3/4) of all sitting council members, excluding those with a conflict of interest, is required.

(2) Motion of Censure
(a) A member of the council may propose a motion of censure to condemn the actions of any individual. A censure shall not impose penalties but shall serve as a formal reprimand.
(b) To pass, the Concurrence of a simple majority of all sitting council members, excluding those with a conflict of interest, is required.

(3) Motion to Amend
(a) A member of the council may propose a motion to amend to a bill that is undergoing the legislative process. A motion to amend may not be filed if a bill has already passed. If passed, the legislative process for the bill, including all previous votes, shall be reset.
(b) To pass, the concurrence of the same majority required for passage of the amended bill in the council is required.

(4) Motion to Override Veto
(a) A member of the council may propose a motion to override veto to override a veto used by the Mayor.
(b) To pass, the concurrence of a supermajority (2/3rds) of all sitting council members, excluding those with a conflict of interest, is required.

(5) Motion to Override Delegation
(a) A member of the council may propose a motion to override the delegation of powers by a Councillor to an Acting Councillor as defined in the Delegation of Powers Act. If passed, the Acting Councillor shall be removed from their position, and all delegated powers shall be returned to the Councillor who originally delegated such powers.
(b) To pass, the Concurrence of a simple majority of all sitting council members, excluding those with a conflict of interest, is required.

4 - Discord Channels and Motion Procedures
(1) The town government shall be required to create a channel named “#council-floor”. This channel shall be under the “🏛 | Aventura Government” category. The channel shall be public; however, only members of the council shall have the ability to send messages.
(a) If a councillor wishes to propose a motion, they shall be required to post it in the “#council-floor” channel.
(b) A template shall be provided in the channel, subject to Mayoral approval.

(2) The town government shall be required to create a channel named “#council-voting”. This channel shall be under the “🏛 | Aventura Government” category. The channel and threads in it shall be public; however, only the Mayor, or if delegated to, the Deputy Mayor, shall have the ability to send messages. Additionally, Councillors shall have the ability to write in threads.
(a) If a councillor has proposed a motion in the “#council-floor” channel, the Mayor, or if delegated to, the Deputy Mayor, shall be required to post the motion in the “#council-voting” channel.
(b) A template shall be provided in the channel, subject to Mayoral approval.
(c) The Mayor, or if delegated to the Deputy Mayor, shall be required to create a thread under the motion.
(d) Councillors shall vote on the motion in the thread, posting the “:aye:” emoji to aye the motion, posting the “:abs~1: ” emoji to abstain, and posting the “:nay~1:” emoji to nay the motion.

5 - Severability Clause
(1) If one part of this law is found to be unenforceable or unconstitutional, only the offending part shall be struck, and the remaining parts shall remain in effect.

Allow the Delegation of Powers and to Amend the Aventura Legislative Motions Standard Act​

The citizens of Aventura, through their elected Representatives in the Town-Council and the force of law ordained to that Town-Council by the people through the constitution of Aventura, do hereby enact the following provisions into the by-laws:

1 - Short Title and Enactment
(1) This Act may be cited as the 'Delegation of Powers Act.'
(2) This Act shall be enacted immediately upon its signage.
(3) This Act has been authored by: Councillor RealImza.
(4) This Act has been co-sponsored by: Mayor AnimeInc

2 - Reasons
(1) If a Councillor is on a leave of absence, their Office becomes inactive and dead.
(2) This act aims to allow Councillors to delegate their powers to an individual to carry them out in such situations

4 - Amendments
(1) The colour red shall mean the removal of the colored text.
(2) The colour green shall mean the addition of the colored text.

(3) The Aventura Legislative Motions Standard Act shall be amended as follows:
