ESTABLISH THE AVENTURA FREE ZONE (AFZA)

The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

PART I — PRELIMINARIES

1. Short Title and Enactment

(1) This Act may be cited as the ‘Aventura Free Zone Act’ or 'AFZA'

(2) This Act shall be enacted immediately upon its signage.

(3) This Act has been authored by Senator unalign.

(4) This Act has been sponsored by Representative Kaizered.

(5) This Act has been co-sponsored by Senator and Aventura Mayor Budgiebud.

(6) This Act amends the following acts:

(a) Criminal Code Act

2. Reasons and Intent

(1) Allowing Illicit items locally would increase enjoyment within the server without ruining crime RP.

(2) Make Aventura the town of fishing and freedom.

(3) Illicit Substance Production is kept illegal anytime, anywhere to keep balance.

(4) Establish legal support for geographic nullification of certain laws, allowing for localized experiments.

(5) Resolve plugin limitations by removing the unworkable WMD murder multiplier, while still allowing WMD possession recreationally under specific nullification criteria.

(6) Punish players who act in bad faith by falsely claiming nullification loopholes.

(7) WMDs are already legal in the wild, so this would not complicate DHS or DoJ work that much.

(8) I will not touch temporal nullification as it was unpopular. Telling if an offence occurred in Aventura is easy, as the region bar on the UI at the top of the screen clearly displays the player's current region.

PART II — AMENDMENTS TO JURISPRUDENCE

3. Establishing Legal Nullification
(1) Part I: Interpretation and Application of the Criminal Code Act shall be amended to add the following section:
9 - Jurisdictional Nullification
(1) Congress maintains the authority to explicitly nullify or exempt the application of specific offences within designated boundaries.
(2) Evidentiary Standard for Nullification: Where a geographic exemption exists within an offence, the State (DHS/DOJ) retains the absolute burden of proving that the conduct occurred. However, the accused bears the burden of producing reasonable evidence (such as the region bar on the UI, F3 coordinate displays, or map usage) demonstrating that the conduct fell within the exempt location to successfully claim the exemption.
(3) Good Faith Enforcement: While the accused bears the burden of proof in contested proceedings, law enforcement officers shall not attempt in bad faith to punish individuals when it is reasonably apparent to the officer that the conduct falls within an exempt location.

PART III — AMENDMENTS TO OFFENCES

4. Amendments to the Criminal Code Act
(1) Part IV, Sections 10, 11, and 12 of the Criminal Code Act shall be amended as follows:

10 - Unauthorised Firearms Possession
Offence Type: Summary
Penalty: 10 Penalty Units; 10 minutes imprisonment; Confiscation of unlicensed firearms
A person commits an offence if the person:
(a) possesses a firearm without holding a valid firearms license.
This offence shall not occur where:
(b) the person can demonstrate the conduct occurred within the town limits of Aventura.

11 - Violation of Firearms License Restriction
Offence Type: Summary
Penalty: 30 Penalty Units; 5 minutes imprisonment; Confiscation of unlicensed firearms; 1 firearms license strike
A person commits an offence if the person:
(a) has a Restricted firearms license; and
(b) handles a restricted firearm.
This offence shall not occur where:
(c) the person can demonstrate the conduct occurred within the town limits of Aventura.

12 - Unauthorised Firearms Sales
Offence Type: Indictable
Penalty: Confiscation of unlicensed firearms; Additionally:
(a) First offence: Up to 50 Penalty Units; Up to 30 minutes imprisonment; 2 firearms license strikes
(b) Subsequent offences: Up to 100 Penalty Units; Up to 60 minutes imprisonment; 3 firearms license strikes
A person commits an offence if the person:
(a) sells, distributes, or traffics a firearm:
(i) for which the recipient of the item lacks the proper licensure to handle; or
(ii) for which the offender lacks the proper licensure to handle.
This offence shall not occur where:
(b) the person can demonstrate the conduct occurred within the town limits of Aventura.

(2) Part V, Sections 7 and 9 of the Criminal Code Act shall be amended, and Section 10 shall be added, as follows:

7 - Careless Operation of Vehicles
Offence Type: Summary
Penalty: 1 Penalty Unit
A person commits an offence if the person:
(a) operates a vehicle off-road, on sidewalks, or otherwise improperly; or
(b) blocks traffic, operates a vehicle on the wrong side, or endangers others; or
(c) while under the influence (25% BAC or higher):
(i) operates a vehicle; or
(ii) operates an aircraft.
This offence shall not occur where:
(d) the person can demonstrate the conduct occurred within the town limits of Aventura.

9 - Illicit Weapon Offences
Offence Type: Summary
Penalty: 5 Penalty Units
A person commits an offence if the person:
(a) possesses, sells, or distributes weaponry without appropriate license.
This offence shall not occur where:
(b) the person can demonstrate the conduct occurred within the town limits of Aventura.

10 - Falsely Claiming Legal Nullification
Offence Type: Indictable
Penalty: The punishment for the associated offence plus 10 Penalty Units
A person commits an offence if the person:
(a) falsely claims the Jurisdictional Nullification exemption in relation to committing another offence.

(3) Part VI, Sections 1, 2, 3, 6, and 7 of the Criminal Code Act shall be amended as follows:

1 - Minor Illicit Substance Possession
Offence Type: Summary
Penalty:
(a) Class 1 Buff - 3 Penalty Units; Seizure of illicit items.
(b) Class 2 Buff - 2 Penalty Units; Seizure of illicit items.
(c) Buff Components - 1 Penalty Unit; Seizure of illicit items.
(d) Buff Seeds - 1 Penalty Unit; Seizure of illicit items.
(e) Weaponized Buffs - 5 Penalty Units; Seizure of illicit items.
(f) Shine Elixir - 1 Penalty Units; Seizure of illicit items.
A person commits an offence if the person:
(a) possesses less than sixty-four of any illicit substances combined.
This offence shall not occur where:
(b) the person can demonstrate the conduct occurred within the town limits of Aventura.

Penalty:
(a) Class 1 Buff - 15 Penalty Units; Seizure of illicit items.

(c) Buff Components - 5 Penalty Unit; Seizure of illicit items.
(d) Buff Seeds - 5 Penalty Unit; Seizure of illicit items.
(e) Weaponized Buffs - 50 Penalty Units; Seizure of illicit items.
(f) Shine Elixir - 5 Penalty Units; Seizure of illicit items.
A person commits an offence if the person:
(a) possesses sixty-four or more of any illicit substances combined.
This offence shall not occur where:
(b) the person can demonstrate the conduct occurred within the town limits of Aventura.

3 - Illicit Substance Trafficking
Offence Type: Indictable
Penalty:
(a) Class 1 Buff - Up to 250 Penalty Units; up to 60 minutes imprisonment; Seizure of illicit items.
(b) Class 2 Buff - Up to 100 Penalty Units; up to 60 minutes imprisonment; Seizure of illicit items.
(c) Buff Components - Up to 100 Penalty Units; up to 60 minutes imprisonment; Seizure of illicit items.
(d) Buff Seeds - Up to 100 Penalty Units; up to 60 minutes imprisonment; Seizure of illicit items.
(e) Weaponized Buffs - Up to 250 Penalty Units; up to 60 minutes imprisonment; Seizure of illicit items.
(f) Shine Elixir - Up to 100 Penalty Units; up to 60 minutes imprisonment; Seizure of illicit items.
A person commits an offence if the person:
(a) sells, distributes, or traffics any quantity of an illicit substance; or
(b) brings illicit substances into Redmont with the intention of selling.
This offence shall not occur where:
(c) the person can demonstrate the conduct occurred within the town limits of Aventura.

6 - Weapon of Mass Destruction Possession
Offence Type: Summary
Penalty: 10 Penalty Units; 1 firearms license strike
A person commits an offence if the person:
(a) possesses a Weapon of Mass Destruction within a public space.
This offence shall not occur where:
(b) the person meets all of the following requirements:
(bi) the person holds a valid Enhanced firearms license; and
(cii) the possession is done with the permission of the DHS Secretary; and
(diii) the possession is done in the course of the person's official duties as a member of the DHS; OR
(c) the person can demonstrate the conduct occurred within the town limits of Aventura.

7 - Weapon of Mass Destruction Trafficking
Offence Type: Indictable
Penalty: Up to 100 Penalty Units; Up to 60 minutes imprisonment
A person commits an offence if the person:
(a) sells or traffics a weapon of mass destruction; or
(b) distributes a Weapon of Mass Destruction.
Instance (b) of this offence shall not occur where:
(a) the person holds a valid Enhanced firearms license; and
(b) the possession is done with the permission of the DHS Secretary; and
(c) the possession is done in the course of the person's official duties as a member of the DHS.
This offence shall not occur where:
(c) the conduct falls under Instance (b), AND the person meets all of the following requirements:
(i) the person holds a valid Enhanced firearms license; and
(ii) the possession is done with the permission of the DHS Secretary; and
(iii) the possession is done in the course of the person's official duties as a member of the DHS; OR
(d) the person can demonstrate the conduct occurred within the town limits of Aventura.

(4) Part X, Section 13 of the Criminal Code Act shall be amended as follows:

13 - Operating Without A License
Offence Type: Summary
Penalty: 1 Penalty Unit
A person commits an offence if the person:
(a) drives a car without a Drivers License, or
(b) pilots a plane or helicopter without a Pilots License.
This offence shall not occur where:
(c) the person can demonstrate the conduct occurred within the town limits of Aventura.

A person commits an offence if the person:

A person commits an offence if the person:

(d) the person can demonstrate the conduct occurred within the town limits of Aventura.

(4) Part X, Section 13 of the Criminal Code Act shall be amended as follows:

13 - Operating Without A License
Offence Type: Summary
Penalty: 1 Penalty Unit
A person commits an offence if the person:

Relevant Law:

This bill is declared out of order. This can be removed when the following is resolved:

1. "Big WMD" is not a Representative. They cannot sponsor this bill. (The sponsor is the person proposing the bill)

Although not required, I would suggest giving unalign the "Senator" title in the author line.
