**ATTN: Arch D. Litt (<@1340117636868083744>)**

1. The Department of Commerce has determined, on reasonable belief, that ArchstoneBanking has been carrying on regulated financial activity in a manner that places customer funds at risk of dissipation or loss.

2. Specifically, the Department concludes that the Operator of ArchstoneBanking has abandoned its business.

3. Furthermore, the Department concludes that ArchstoneBanking may be insolvent and unable to pay out outstanding balances or process customer withdrawal requests.

4. Accordingly, the Department of Commerce hereby issues a FREEZE ORDER. No deposits, withdrawals, transfers, disposals, or advertising of the operation may occur. Disposal of frozen funds is an indictable offence.

5. Customers are directed not to transact further with ArchstoneBanking. Affected customers should open a Department of Commerce ticket stating their account name and the amount owed.

6. The Department of Commerce will further petition the Federal Court to appoint a Receiver over ArchstoneBanking.

7. Any recovered, frozen, or seized assets will be applied first to the restitution of customers in accordance with Section 50(3) [RCFA](https://www.democracycraft.net/threads/redmont-commerce-and-finance-act.42952/).

Receivership: ArchstoneBanking
receivership · filed by edwardcul1en

edwardcul1en is appointed receiver. Ground: the entity is insolvent (RCEA s75(3)). A. Abandonment of the institution by its Operators

1. The First Respondent has a sole director listed on its company register (A-001), who has since resigned (A-002). Based on information from that former director and others involved with the firm, the Second Respondent has total control over the firm's infrastructure and finances. It has no other Operator, officer, or agent capable of acting on its behalf (A-004).

2. The Second Respondent has publicly resigned from the institution as CEO and offered to sell her shares in the company (A-005). However, later posts express an unwillingness to sell the institution despite the Second Respondent's desire to cease operations (A-006).

3. The First Respondent is accordingly an institution holding customer deposits with no Operator present or reachable to administer it. It has abandoned its business.

B. Insolvency

4. The First Respondent filed a financial statement with the Respondent on September 5th, 2026. This Financial statement showed the firm holding a negative balance in the equity account (A-007). Under the definition Part 1 Section 3(d)(ii) of the Bankruptcy Act, this qualifies the First Respondent as insolvent.

5. The Applicant raised concerns with the First Respondent pertaining to the solvency of their institution, with the negative shareholder's equity being of particular concern to the Applicant (A-008). The Second Respondent replied as an agent of the First Respondent, claiming that an error had occurred with assembling the financial statements.

6. The Second Respondent, acting as an agent of the First Respondent, later replied with a claim that the firm had not conducted any regulated financial activity in the reporting period, and was therefore not required to file a financial institution report (A-009).

7. On September 21st 2026, the Applicant notified both respondents that a financial institution report still needed to be filed, and included evidence that substantive transactions occurred during the reporting period in question. No further response was received from either respondent (A-010).

C. Depositor claims
8. The Applicant has received a depositor claim against the First Respondent from RealGamer203 (A-011).

9. The claimant has requested the return of funds held by the First Respondent and has not been paid. No withdrawal, redemption, or repayment request has been honored.

10. Each such failure is a violation of the Redmont Civil Code Act (Failure to Honour Withdrawal or Redemption), being a strict liability violation for which specific performance and restitution are available remedies.

11. The total sum on deposit and the full number of depositors are not known to the Department, the Second Respondent having provided no account of the institution's customer liabilities.

D. The orders already made

12. On 5 October 2026, the Applicant served a notice requiring both respondents to "produce records, transaction logs, communications and account data, to identify all persons, accounts, customers and amounts involved, and to account for the location and disposition of all customer funds." as provided in Part X Section 43(1) of the Redmont Commerce and Finance Act (A-012).

13. The respondents did not produce any records, allowing the Applicant to draw adverse inferences and to proceed on any reasonable basis pursuant to Section 43(4) of the Act.

14. The Applicant has issued a freeze order on 5 October 2026 under Section 48(1), taking effect immediately on service (A-013). This Petition is brought within 72 hours of that service, as required by Section 48(3).

Court Order

IN THE FEDERAL COURT OF THE COMMONWEALTH OF REDMONT
ORDER APPOINTING RECEIVER AND CONFIRMING AND VARYING FREEZE ORDER

The Federal Court has considered the application of the Commonwealth of Redmont, acting through the Department of Commerce, filed on 5 October 2026 under Sections 48(3) and 50(1) of the Redmont Commerce and Finance Act ("the Act").

On the evidence filed, the Court is satisfied that the Department reasonably believes receivership necessary to protect customer funds, and that this belief is well founded. ArchstoneBanking carries on regulated financial activity by taking deposits as a Class A Commercial Bank. Its depositors have been unable to withdraw since at least 28 September 2026. Archelit_ announced on 30 September 2026 that she was stepping away, agreed on 3 October 2026 to reopen withdrawals but did not do so, and did not answer the Department's notice under Section 43(2) of the Act. Its registered director has resigned and says he never had access to its records. The Court makes no finding that ArchstoneBanking is insolvent.

Because of the urgency, the Court decides this application without first hearing Archelit_ or any other affected person (Sections 48(2) and 54(4) of the Act). Any of them may apply under paragraph 9.

The Court ORDERS as follows:

1. Appointment of Receiver
edwardcul1en is appointed Receiver under Section 50(1) of the Act over ArchstoneBanking (DOC-CO-0134; registered financial institution DOC-FI-0020) and over the relevant assets of its Operator Archelit_, with immediate effect. The Receiver shall confirm his acceptance in this thread. His duties under this Order are owed to this Court (Section 75(7) of the Redmont Corporate Entities Act).

2. Powers of the Receiver
The Receiver holds the powers in Section 50(2) of the Act and, by Section 75(8) of the Redmont Corporate Entities Act read with Section 61(3) of the Act, those in Section 75(4) of that Act. In particular, the Receiver may:

take control of all customer funds and operational assets of ArchstoneBanking, including all business, checking and savings balances;
request balance information from, and withdrawals of, any reserves held by or for ArchstoneBanking with the Federal Reserve Bank;
exercise the powers of its directors, managers, officers and interest holders, and suspend the voting and control rights of any interest holder;
suspend its activities in whole or in part;
establish and publish a depositor claims process, and determine the number of depositors and the sums owed to each;
honour or restore valid withdrawals and redemptions to the extent required by law;
identify, preserve and recover assets for the benefit of customers and creditors; and
wind down ArchstoneBanking in an orderly manner.

3. Freeze Order confirmed and varied
Under Section 48(3) of the Act, the Freeze Order served by the Department on 5 October 2026 is confirmed and varied so that it applies to:
all balances and assets of ArchstoneBanking, including any reserves held with the Federal Reserve Bank; and
the personal balance and assets of Archelit_, up to $145,208.84.
It remains in force until further order of this Court and does not restrict any dealing by the Receiver under this Order.

4. Production and preservation
Within 48 hours of service of this Order, Archelit_, Riniki_ and any other person with access to the systems through which ArchstoneBanking keeps its accounts shall produce to the Receiver and the Department:
the full depositor ledger, showing each account holder and balance;
an export of the data held by the ArchstoneBanking bot and website;
all transaction logs from 31 August 2026; and
an account of the $100,000 paid to Archelit and the $44,000 corporate withdrawal shown in the report filed with the Department on 5 September 2026.
Each of them shall preserve all such records and data and shall not delete, alter, conceal or destroy them (Section 43(3) of the Act). This Order does not require the transfer of any Discord bot, server or website.

5. Cooperation
Archelit_, Riniki_, Markaij and every officer, agent or other person able to exercise control over ArchstoneBanking shall cooperate fully with the Receiver and disclose all assets, accounts and records within their knowledge or control.

6. Reports
The Receiver shall report in this thread within 7 days of this Order, and every 7 days after that until discharged, stating the number of depositors and sums owed, the assets located (including any Federal Reserve Bank reserves), where the $100,000 and $44,000 outflows went, and the claims process adopted.

7. Application of recovered assets
Under Section 50(3) of the Act, the Receiver shall apply recovered assets first to the restitution of customers, and thereafter to creditors, penalties and the costs of the receivership. Determinations under the deposit guarantee remain with the Department under Section 24 of the Act. The Receiver shall coordinate with the Department so that no depositor recovers the same loss twice (Section 24(10)).

8. Tracing and personal liability
Under Section 49 of the Act, the Department is granted leave to trace and recover customer funds from third parties who received them otherwise than in good faith and for fair value. Nothing in this Order relieves Archelit_ of personal liability under Section 53(1) of the Act, and under Section 53(3) that liability is not avoided by resignation, departure or any transfer of ownership or control.

9. Liberty to apply
Archelit_, or any interest holder, creditor or depositor of ArchstoneBanking, may apply in this thread to vary or discharge this Order within 7 days of service. This Order remains in force while any such application is decided.

10. Service
The Department shall serve this Order on Archelit_, Riniki_ and Markaij without delay and confirm service in this thread.

11. Reservation
The Court may vary, extend or discharge this Order and make any further order necessary to preserve depositor funds.

So ordered,
Judge Theory Fontaine

The receiver, edwardcul1en, conducts the winding up.
