CONGRESS OF THE
COMMONWEALTH OF REDMONT






A BILL TO

LESSEN ILLEGAL ADVERTISING PUNISHMENTS TO GIVE PLAYERS A WARNING, AND DOUBLE IT INSTEAD







The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:


PART I — PRELIMINARIES

1. Short Title and Enactment


(1) This Act may be cited as the ‘Advert Scaling Act’

(2) This Act shall be enacted immediately upon its signage.

(3) This Act has been authored by Representative Dogen851 with input from Speaker _GreyMC, Johnes and sonofalancer.

(4) This Act has been co-sponsored by Speaker _GreyMC.

(5) This Act amends the following acts:

(a) Criminal Code Act.

2. Reasons and Intent

(1) Warn players of advertising illegally
(2) Change the punishments to better fit the crime

PART II - AMENDMENTS

3. Criminal Code Act

(1) Section 7 of the Criminal Code Act shall be amended as follows:

7 - Illegal Advertising

(a) First Offence - 5 1 Penalty Units.
(b)
Second Offence - 10 5 Penalty Units.
(c) Subsequent Offences - 25 5 penalty units extra per offence added to the penalty of the last offence, capping at 25 Penalty Units
A person commits an offence if the person:
(a) advertises a business, goods, service or a political campaign or party in a public chat not designated for advertising; or
(b) advertises a gaming institution or gambling in a public chat designated for advertising.
(c) advertises an illicit service, item, or other form of transaction that is deemed criminal by this act.
(i) This offence shall not occur when it is advertising specifically for a BM's (Black Market's) services in a proper channel.

:nay: - I see absolutely no reason for this act. First, reasons and intent (1) is not fulfilled by this act. Second, as Lance-Iris Holmes stated, this act does not address the issue of campaigning in #advertise. Third, the scaling is not good. I see no reason to change the second and subsequent punishments for illegal advertising. A $60 fine serves as a good warning, but after your warning, if you continue to offend, you deserve real punishment. No reason for the change to second and subsequent offenses is given within the reasoning.

The Advert Scaling Act rewrites the penalty for Illegal Advertising in the Criminal Code Act. A first offence falls from 5 to 1 Penalty Unit, a second from 10 to 5, and each offence after that adds 5 Penalty Units to the last, stopping at 25. It also adds services and political parties to the things that may not be advertised outside the channels set aside for it. Most first offences under this section are new players who have not yet learned which chat is which, and a $600 fine is a poor introduction to the Commonwealth. A $120 fine that climbs quickly for those who keep doing it fits the offence better, and the ceiling for the persistent advertiser is unchanged.

I record the following for Congress and for the Office of Congressional Affairs. These are not conditions of my assent.

1. The Bill amends "Section 7 of the Criminal Code Act". The Code restarts its numbering in every Part, and several Parts have a section 7. The section the Bill reproduces is Illegal Advertising, Part X, §7, and that is the only section it touches.

2. The Bill shows only the lines it changes. The lines it does not show, in particular "Offence Type: Summary" and the "Penalty:" heading, are not marked for removal and remain. The Office should insert the new lettered penalty ladder beneath the existing Penalty heading and leave the rest of the section as enacted. Illegal Advertising remains a Summary offence enforced by the Department of Homeland Security.

3. The ladder in paragraph (c) is to be read as fixed amounts: 1, 5, 10, 15, 20 and 25 Penalty Units for the first to sixth offence, and 25 for every offence after that. "The penalty of the last offence" means the penalty this section prescribes for that offence, not the sum a person actually paid under the old rates. A person with prior convictions keeps their place on the ladder and is charged at the new amount for that place.

4. Charges pending at the date of this assent take the new, lesser penalty by operation of Part I, §6(3)(c) of the Code.

5. The long title speaks of a warning and of doubling. The text enacts neither. The first offence carries a fine of 1 Penalty Unit, and the ladder rises by 5 Penalty Units a step. The Department should apply the text. If Congress wants a formal warning in place of the first fine, it should enact one.

Accordingly, I assent to this Bill, and it is enacted as law.
