COMPLAINT
The Plaintiff complains against the Defendant as follows:


On The 4th of January 2025, the Plaintiff signed a contract with the Defendant (P-001), stating that the Plaintiff would provide the Defendant with $400 per item frame for a painting with the size of 5x5.

However, the defendant has breached his end of the contract, going past the agreed end-date of 4 calendar days.

This outrageous conduct has deprived the Plaintiff from the joy and satisfaction they could have received with their art.

I. PARTIES
1. MrEntomology (Plaintiff)
2. byleth_irl (Defendant)

II. FACTS
1. On the 4th of January 2025, the Plaintiff signed an agreement with the Defendant.
2. The contract stipulated that the Plaintiff would pay $400 for each item frame for a painting sized 5x5.
3. As of the 7th of March 2025, the Defendant has yet to fulfill their end of the contract.

III. CLAIMS FOR RELIEF
1. The Defendant committed a Breach Of Contract, Per the Contracts Act, as they have failed to begin the creation of this art piece.
2. This breach of contract is outrageous and unreasonable.
3. The Plaintiff has lost enjoyment from being deprived of this art piece.

IV. PRAYER FOR RELIEF
The Plaintiff seeks the following from the Defendant:
1. $10,000 in compensatory damages, as that is what the total price of the painting was.
2. $8,000 in punitive damages, as this breach of contract was outrageous.
3. $8,000 in consequential damages. in the form of Loss Of Enjoyment, as the Plaintiff was deprived of enjoyment, from not owning the painting.
4. $7,800 in Legal Fees, equal to 30% of the value of damages.

By making this submission, I agree I understand the penalties of lying in court and the fact that I am subject to perjury should I knowingly make a false statement in court.

@byleth_irl is required to appear before the Federal Court in the case of MrEntomology v. byleth_irl [2025] DCR 27

Failure to appear within 72 hours of this summons will result in a default judgement based on the known facts of the case.

Both parties should make themselves aware of the Court Rules and Procedures, including the option of an in-game trial should both parties request one.

I. ANSWER TO COMPLAINT
1. The Defense affirms on the 4th of January 2025, the Plaintiff signed an agreement with the Defendant.
2. The Defense affirms the contract stipulated that the Plaintiff would pay $400 for each item frame for a painting sized 5x5.
3. The Defense neither confirms nor denies as of the 7th of March 2025, the Defendant has yet to fulfill their end of the contract.

II. DEFENCES
1. The plaintiff is not owed the amount in compensatory damages as payment has not been shown to have been sent to the defendant, and the contract (page 5,6) stipulates payment comes after delivery and inspection.
2. If a breach of contract had occurred, then that is what liquidated damages are intended for, Legal Damages Act -- Section 8 - Liquidated Damages, this is specifically outlined to to collect compensation upon a breach. The contract does not contain this, so counsel is attempting to claim it through Punitive Damages.
3. Punitive damages are intended to punish for outrageous conduct and intended to ‘deter’, a breach of contract itself is not outrageous conduct -- and there’s already a venue intended to deter that very thing and parties agreed not to make use of it in their contract by virtue of it lacking.
4. Loss of Enjoyment doesn’t make sense here, Legal Damages Act -- Section 7 - Consequential Damages, as the plaintiff was not diminished from engaging in certain activities any differently than before by not having the painting.

I am not on discord so it makes this process more difficult.
