CONGRESS OF THE
COMMONWEALTH OF REDMONT
A BILL TO
AMEND THE CRIMINAL CODE ACT TO PROTECT THE RIGHT TO LEAVE A UNION
The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:
PART I — PRELIMINARIES
1. Short Title and Enactment
(1) This Act may be cited as the ‘Union Freedom of Association Act’
(2) This Act shall be enacted immediately upon its signage.
(3) This Act has been authored by Representative EATB.
(4) This Act has been co-sponsored by President of the Senate Talion77.
(5) This Act amends the following acts:
(a) Criminal Code Act
2. Reasons and Intent
(1) The way "Union Busting" is currently written in the Criminal Code Act makes it a crime to "take action to disrupt or dismantle a union" without any exceptions.
(2) This broad language basically makes it a crime for a union member to quit or leave a union because leaving a union naturally changes its membership numbers, resources and power to negotiate together.
(3) It also makes it a crime for union members to peacefully and voluntarily close their union if they all agree to do so.
(4) Making it clear that quitting a union and closing it down voluntarily are not the same as "Union Busting" protects freedoms and aligns the law with the constitutional right to freedom of association.
PART II — AMENDMENTS TO THE CRIMINAL CODE ACT
Amendments to Union Busting Offence
(1) Part V, Section 5 of the Criminal Code Act shall be amended as follows:
"5 - Union Busting
Offence Type: Indictable
Penalty: Up to 200 Penalty Units
A person commits an offence if the person:
(a) takes action to disrupt or dismantle a union.
This offence shall not occur where:
(b) the action is a union member exercising their right to leave, resign from, or terminate their membership in the union; or
(c) the action is the voluntary dissolution of the union by a vote of its own membership in accordance with the union’s established bylaws.
