Provide towns with an effective way to have federal exemptions

The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment

(1) This Act may be cited as the “Substance Autonomy Act"

(2) This Act shall be enacted immediately upon its signage.

(3) This Act is authored by President Westray, inspired as an alternative to The Town Exemption Act.

(4) This Act is co-sponsored by Rep. SlimeGlitch, Deputy Speaker A__C, and Senator black_ven0m

2 - Purpose

(1) Towns have called for exemptions to be granted to them for drug laws. Legislation has been proposed to allow this, however it lacks clarity.

(2) This bill seeks to clearly define the processes and empower the government to support towns in federal law exemptions.

(3) With this act, the Department of State is hereby encouraged to arrange a process with towns in which they can apply for the power to create exemption licenses.

3 - Substance Licenses

(1) The Executive may grant licenses to the sale of illicit drugs and substances that would exempt individuals from laws on trafficking that they would be normally subject to.

(2) Specifics on which substances can be sold through these licenses can be determined on a case-by-case basis.

(3) The process whereby licenses are granted and revoked would be at the discretion of the delegating authority.
4 - Town Authorities

(1) The Department of State may, at their discretion, delegate the authority to grant such licenses to towns.

(a) In such an instance, towns would be able to determine the process whereby licenses are granted and revoked for their own residents.

(2) Licenses can apply to town-specific jurisdictions. For instance, an individual with a license may be able to sell drugs in one town, but not in the city.



5 - Legal Protections

(1) Any individual found falsely claiming to have a license may be subject to charges of fraud.

(2) The Department of Justice must be able to reasonably tell that an individual has a license. If an individual purposefully conceals a license to sell drugs, the department is not liable for wrongful arrest.
