BILL
To
Amend the Constitution
1 - Short Title and Enactment
(1) This Act may be cited as the 'Second Mayoral Authority Clarification Act'
(2) This Act shall be enacted immediately upon its signage.
(3) This Act has been sponsored by Head of Residence Sir_Dogeington.
(4) This Act has been co-sponsored by Head of Urban Development Talion77.
2 - Reasons
(1) The duties of the Mayor are ill-defined and overbroad.
(2) There is a lot of overlap in the duties of the Mayor and town offices.
(3) The constitution should define the powers of the Executive.
3 - Amendment to Article II
The following amendments shall be made to Article II of the Constitution:
Section I - Oakridge shall have Offices which shall be established in this Constitution. Each Department shall have specific duties, responsibilities, and powers which shall be listed in this Article. The Head of an Office shall be a Council Member who is elected to that Office, unless stated otherwise. The Head of an Office shall retain the power to decide the rank structure of their respective Office. The following are the Offices of Oakridge:
Section II - Oakridge shall have two types of Office Heads.
(a) Legislative Heads, which are members of the Town Council and elected by Oakridge Citizens.
(b) Executive Heads, which are appointed by and serve at the pleasure of the Mayor, and are not members of Town Council.
Section III - The Offices of Oakridge are as follows:
a) Office of Commerce
The Office of Commerce is charged with the following responsibilities:
(1) Administration of town grants and the registration of local businesses.
(a) Office of Commerce leadership shall not accept their own grants.
(2) Approval of commercial structures or spaces.
(3) Creation of economic regulations, if approved by the Town Council and not overridden by an Act of Council.
(4) Protection of the Town's economic interests.
Leadership:
(1) Head of Commerce
(a) The Head of Commerce is a Legislative Head
b) Office of Urban Development
The Office of Urban Development is charged with the following responsibilities:
(1) Creation of Government infrastructure, including commercial and residential structures.
(2) Management of public transport within Oakridge.
Leadership:
(1) Head of Urban Development
(a) The Head of Urban Development is a Legislative Head
c) Office of Community Affairs
The Office of Community Affairs is charged with the following responsibilities:
(1) Maintaining an active and satisfied Oakridge community.
(2) Holding regular Press Conferences with the public.
(3) Hosting events within the Town of Oakridge.
(4) Managing any social media accounts owned by the Town of Oakridge.
(5) Providing aid to residents seeking to host their own events within the Town of Oakridge.
(6) Creating monthly approval ratings surveys for elected officials and major changes within the Town of Oakridge.
(7) Facilitation of guided tours throughout the Town of Oakridge.
Leadership:
(1) Head of Event Coordination
(a) The Head of Event Coordination is a Legislative Head
d) Office of Legal Affairs
The Office of legal affairs is charged with the following responsibilities:
(1) Advising the Mayor and town council over any legal matters.
(2) Make sure all Town laws are abiding by the Commonwealth's.
(3) Representing the Town in Court.
Leadership:
(1) Town Attorney General
(a) The Town Attorney General is a Legislative Head
e) Office of Residence
The Office of Residence is charged with the following responsibilities:
(1) Approval of residential all structures or spaces built by the Office of Urban Development for the purpose of ensuring theme compliance.
(2) Creation of building regulations, if approved by the Town Council and not overridden nor pre-empted by an Act of Council.
(3) Maintenance and enforcement of building regulations.
(4) Management of evicted plot auctions within Oakridge.
Leadership:
(1) Head of Residence
(a) The Head of Residence is a Legislative Head
f) Oakridge Postal Service
The Oakridge Postal Service is charged with the following powers and responsibilities:
(1) Responsible for the establishment and management of rented P.O (Post Office) deposit boxes.
(2) Responsible for the establishment and management of a Post Office building.
(3) Responsible for the regulation of the movement of packages from one place to another.
(4) The power to search any package(s) for items that are illegal under federal or local law.
(5) The power to refuse the shipment of items, excluding legal firearms and their accessories that have been shipped by an armorer, that may cause harm to the receiver or others around them.
Leadership:
(1) Postmaster General
(a) The Postmaster General shall be appointed by the Mayor of Oakridge, and shall not be a member of the Town Council. The Postmaster General is an Executive Head
g) Oakridge Police Department
The Oakridge Police Department is charged with the following responsibilities:
(1) Maintaining the peace and good order of the Town of Oakridge, through lawfully exercising its power equally to enforce the laws of the Town of Oakridge
(2) Providing security to Oakridge government officials and events
(3) Maintaining criminal records for local crimes within Oakridge
(4) Providing criminal records upon request (the requesting individual must be party to the record requested, or be a court ordered request) within 7 days.
Leadership:
(1) Sheriff
(a)The Sheriff shall be appointed by the Town council of Oakridge, and shall not be a member of the Town Council. The Sheriff is an Executive Head.
(b) The Sheriff must be a current Police Officer or higher rank in the Department of Homeland Security.
4 - Amendment to Article III
The following amendments shall be made to Article III of the Constitution:
Section I - The Executive Power in Oakridge shall be vested in a Mayor of Oakridge.
(a) The Mayor of Oakridge must who shall be elected with a Deputy Mayor of Oakridge.
(b) The Deputy Mayor of Oakridge derives their authority through delegated Mayoral executive authority.
(i) In the event that the Mayor of Oakridge takes a leave of absence, the duties of the Mayor may be temporarily delegated to the Deputy Mayor.
(ii) in the event that the Deputy Mayor of Oakridge takes a leave of absence, and a council vote is tied, the vote shall be tie broken by the Chief of Staff.
(c) The Mayor of Oakridge may hire a Mayoral advisor
(i) The Mayoral advisor shall advise the Mayor on matters relating to the Executive, in addition to any other mayoral duties delegated to them.
The Mayor of Oakridge shall represent the Town in court, or may appoint another player to do so.
Section II - In the event that the Mayor of Oakridge is absent or unable to perform their duties, the Deputy Mayor shall assume the Office of the Mayor until the Mayor of Oakridge is present and able to perform their duties.
In the event that the Deputy Mayor of Oakridge is absent or unable to perform their duties, the Mayor shall assume the Office of the Deputy Mayor until the Deputy Mayor of Oakridge is present and able to perform their duties.
Section II - The Order of Succession of the Mayorship of Oakridge is as follows.
(a) In the event that the Mayor is incapacitated, removed from office, resigns, or is inactive for more than 14 days unannounced, the Deputy Mayor will assume the Mayorship.
(i) The new Mayor of Oakridge shall then nominate a new Deputy Mayor of Oakridge, which shall assume Office only when approved with a majority vote from the Town Council.
(b) In the event that the Deputy Mayor is also incapacitated, removed from office, resigns, or is inactive for more than 14 days unannounced, the Chief of Staff will assume the Mayorship.
Section III - In case of a removal of the Mayor of Oakridge from Office, or of resignation, or inability to discharge the Powers of said Office, the Deputy Mayor of Oakridge shall assume Office of the Mayor of Oakridge. The new Mayor of Oakridge shall then nominate a new Deputy Mayor of Oakridge, which shall assume Office only when approved with a majority vote from the Town Council.
In case of a removal of the Deputy Mayor of Oakridge from Office, or of resignation, or inability to discharge the Powers of said Office, the Mayor of Oakridge shall nominate a new Deputy Mayor of Oakridge, which shall assume Office only when approved with a majority vote from the Town Council.
Section III - The duties of the Mayor of Oakridge are as follows:
(a) The execution and enforcement of the laws of Oakridge, unless otherwise delegated to town offices by this constitution or town bylaws.
(b) The maintenance of peace through the Oakridge Police service.
(c) The continued operation and efficiency of the Oakridge Postal Service.
(d) Approving of or vetoing legislation.
(e) Issuing Mayoral Mandates.
(i) A Mayoral Mandate is an order issued by the office of the Mayor to suggest action of the Offices of Oakridge, these mandates are non-binding.
(f) To act as the representative of Oakridge, defending the town’s interests, in Redmont’s Federal Government.
Section IV - The Mayor of Oakridge or the Deputy Mayor of Oakridge shall be removed from their position following a supermajority vote of approval for their removal among the Town Council. All Council Members must vote on the removal, excluding the player the vote is to remove, should they be both on the Town Council and Mayor of Oakridge or the Deputy Mayor of Oakridge.
5 - Amendment to Article IV
The following amendments shall be made to Article IV of the Constitution:

Section VI In case of a removal of both the Mayor of Oakridge and Deputy Mayor of Oakridge from Office, or of resignation, or inability to discharge the Powers of said Offices, a Special Election for the Office of the Mayor of Oakridge shall be facilitated within 24 hours, given there is no Mayoral Election scheduled in the following 7 days.
(a) Should the office of the Mayor of Oakridge be left vacant following the incapacitation, removal from office, resignation, or inactivity of the Mayor of Oakridge, Deputy Mayor of Oakridge, and Chief of Staff, a Special election for the Office of the Mayor of Oakridge shall be held within 24 hours of the vacancy, given that there is no Mayoral Election scheduled within 7 days of the vacancy.
(i) Should the vacancy occur within seven days of a Mayoral election, the council will enter a caretaker state where all bills proposed shall have their voting period delayed until the office of the mayor is occupied, and the town council will assume the duties of the mayor in interim.
In case of a removal of a Council Member from Office, or of resignation, or inability to discharge the Powers of said Office, a Special Election for their Office shall be facilitated within 24 hours, given there are no Town Council Elections scheduled in the following 7 days, excluding Special Elections and Run-Off Elections.
(b) Should a legislative Head of Office position be left vacant following the incapacitation, removal from office, resignation, or inactivity of the Council member in question, a Special Election for their Office shall be facilitated within 24 hours, given there is not a General Town Council Elections scheduled in the following 7 days.
(i) Should the vacancy occur within seven days of a Town Council General Election, then the duties of that Head of Office shall be performed by the Chief of Staff until the position is filled.
