A BILL TO

PROPERLY AND SAFELY ESTABLISH THE RIGHT TO STRIKE

The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

PART I — PRELIMINARIES

1. Short Title and Enactment

(1) This Act may be cited as the ‘Right to Strike Act’

(2) This Act shall be enacted immediately upon its signage.

(3) This Act has been authored by Senator Dartanboy.

(4) This Act has been co-sponsored by Representative Ameslap.

(5) This Act amends the

(a) Executive Standards Act.


2. Reasons and Intent

(1) The Right to Strike is important; however, we must ensure it does not encroach upon the Right to Not Strike.

(2) Emergency services must never be stopped.

PART II — Necessary Changes to Establish a Right to Strike

1. Repealing the Secondary Strike Act

(1) The Secondary Strike Act shall be repealed.

(a) Any amendments introduced by the Secondary Strike Act shall be reversed.

2. Amending the Executive Standards Act

(1) Section 7 of the Executive Standards Act shall be amended with the following:

(1) The Department of Homeland Security is charged with the following primary responsibilities:
(a) Maintaining the peace and good order of the nation, through lawfully exercising its power equally to enforce the laws of the Commonwealth of Redmont.
(b) Administration of a Federal impound and providing security to government officials and events.
(c) Maintaining criminal records
(d) Providing criminal records upon request (the requesting individual must be party to the record requested) within 7 days.
(e) Protecting and Defending Redmont and its interests.
(2) The Department is considered an 'emergency services' provider.
(2) Leadership:
(a) Secretary of the Department of Homeland Security.
(b) Deputy Secretary of the Department of Homeland Security.
(3) Seal:

(2) Section 12 of the Executive Standards Act shall be amended with the following:

12 - Department of Health

(1) The Department of Health is charged with the following primary responsibilities:

(a) Maintenance and upkeep of the national health system.

(2) The Department is considered an 'emergency services' provider.

(2) Leadership:

(a) Secretary of the Department of Health

(b) Deputy Secretary of the Department of Health.

(3) Seal:

(3) Section 15(1) of the Executive Standards Act shall be amended with the following:

15 - Emergency Services
(1) Government Employees of an Emergency Service provider cannot refuse to work or ignore the duties of their job.
(1) Emergency Service Providers cannot refuse to work or ignore the duties of their job.
(a) The following are considered Emergency Service Providers:
(i) Any employee of the Department of Health who, during their regular duties, assists citizens of Redmont in overcoming illnesses, injuries, or other health conditions in Redmont.
(ii) Any employee of the Department of Homeland Security who, during their regular duties, enforces criminal laws in Redmont.

PART III — Establishing the Right to Strike

1. Right to Strike

(1) All Government Employees are afforded the Right to Strike, except those which qualify as an Emergency Service Provider under the Executive Standards Act.

(2) Additionally, Government Employees are afforded the Right to Not Strike, meaning no force, save for one's own conscience, may compel an individual to strike.

Good bill, wrong time. We need to debate on this further and get a lot more opinions, and make sure staff won't veto it. For example, when can departments strike, probably when their members vote yes in a majority maybe? We also don't prevent strikes from being really destructive, which is something we should do.

Also, we have way to much to do right now with passing older bills, then we can work on figuring out strikes.
