To
Amend the Constitution and the Legislative Standards Act
The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:
1 - Short Title and Enactment
(1) This Act may be cited as the 'Motion to Judicially Review Act.'
(2) This Act shall be enacted immediately upon its signage.
(3) This Act has been authored by Rep. zLost.
(4) This Act has been co-sponsored by Rep. Cashtron527.
2 - Reasons
(1) Congress can be unsure regarding the law, such as in parts of the law where requirements for something are not explicitly mentioned.
(2) For example, some representatives might believe that a bill is a complex change while others might argue it is not.
(3) To solve these disputes, a way to get a judicial opinion regarding a matter in congress is needed.
3 - Amendment
The following will be added under Section 12 "Congressional Motions" of the Legislative Standards Act:
(13) Motion to Judicially Review
(a) Representatives or Senators may motion for a judicial review by the Chief Justice regarding a matter of legislative interpretation. Such as, but not limited to, when needing to clarify whether a bill is a complex change or not.
(b) When the motion is passed, a thread will be created in #oversight and the Supreme Court will be summoned. The Chief Justice will have 72 hours to give their interpretation on the matter. If they do not, they will be given a charge of Contempt of Congress for every 12 hours they do not respond. The Speaker may give an extension if the Chief Justice requests so.
(c) Once the Chief Justice has given their opinion, their interpretation will be legally binding unless the two other Justices have an opposing interpretation. In this case, the opposing interpretation will be legally binding.
