Improve the Judicial Process


The people of Democracy Craft, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:




1 - Short Title and Enactment
(1) This Act may be cited as the “Legal Standing Act”.
(2) This Act shall be enacted immediately upon its signage.
(3) This Act is proposed by Representative Hong_Kong_101
(4) This Act is co-sponsored by Senator Overloard of Peonys

2 - Reasons
(1) Recent lawsuits have had citizens file suit against the government for incidents in which they suffered no tangible or measurable loss.
(2) The practice of allowing ordinary lawyers to file criminal cases in court subverts the judicial system by undermining the duties of the Department of Legal Affairs.

3 - Provisions
(1) In filing a civil suit, all plaintiffs must prove that the defendant in their case, through action or through negligence, directly caused a loss of property or financial assets to the plaintiff. Should the plaintiff not prove such in filing their case, the case may be dismissed with prejudice at the request of the defendant.
(a) Losses that cannot be quantified, objectively proven, or compensated monetarily, such as emotional damages will not count towards proving the standing of a plaintiff.
(2) All cases in which the plaintiff attempts to obtain a fine, jail term, or other punitive action taken by the government that goes beyond restoring any loss of property or financial assets to the plaintiff will be classified as criminal cases.
(a) Criminal cases can only be filed by an employee of the Department of Legal Affairs acting in their official capacity as an employee of that department. Should a criminal case not meet this requirement, the case may be dismissed without prejudice at the request of the defendant.
