Ensure the Return of Government Property​

The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as the 'Government Property Return Act.'
(2) This Act shall be enacted immediately upon its signage.
(3) This Act has been authored by Representative RealImza, with suggestions from Senator Gribble.
(4) This Act has been co-sponsored by Representative Scassany.

2 - Reasons
(1) The A Cool Government Property Return Act is outdated and contains unprofessional wording.
(2) With the passing of the Criminal Code Act, the “Failure to Return Government Property” crime within the A Cool Government Property Return Act became non-functional.
(3) This act is a newer version of the A Cool Government Property Return Act that additionally amends the Criminal Code Act to include the “Failure to Return Government Property” crime within it.
(4) Acting Homeland Security Secretary Rory has endorsed this bill.

3 - Repeals
(1) The A Cool Government Property Return Act shall be repealed in its entirety.

4 - Return of Government Property
(1) All items given out by a government department to its employees for the sake of the duties of their employment are to be returned promptly upon termination of their employment with the government department or when such items are no longer required for their duties under the employment.
(a) This section will not apply if the government department has specified that an item may be kept.
(b) The government department may set a specific time frame for the return of an item.
(i) If no specific return time is set, the standard time frame in which the item must be returned will be 7 days.
(2) Any person who holds the rank of Sergeant or higher within the Department of Homeland Security may request logs from the staff team regarding illegally held government items.
(a) A warrant will not be required for this.
(b) For a request to be valid, the requester must have probable cause that the target illegally possesses government property.
(3) All government items illegally possessed by a person that have been found in a staff log will be seized and returned to the respective government department.
(a) Any profits made from selling this government item to another player will be returned through the /fine and /unfine commands.

5 - Amendments
(1) Part VII of the Criminal Code Act shall be amended as follows:

24 - Failure to Return Government Property
Offence Type: Summary
Penalty:
(a) First Offence - 1 Penalty Unit.
(b) Second Offence: 2.5 Penalty Units.
(c) Third and Subsequent Offences: 10 Penalty Units.
A person commits an offence if the person:
(a) fails to return government property within 24 hours of the set return time as defined in Section 4.(1).(b) of the Government Property Return Act.
