CONGRESS OF THE COMMONWEALTH OF REDMONT
A BILL TO
REPEAL THE DECLARATIONS ACT AND RESTORE THE PREVIOUS ELECTORAL
FRAMEWORK
The people of the Commonwealth of Redmont, through their elected
Representatives in the Congress and the force of law ordained to that Congress
by the people through the constitution, do hereby enact the following provisions
into law:
A BILL TO
REPEAL THE DECLARATIONS ACT AND RESTORE THE PREVIOUS ELECTORAL
FRAMEWORK
The people of the Commonwealth of Redmont, through their elected
Representatives in the Congress and the force of law ordained to that Congress
by the people through the constitution, do hereby enact the following provisions
into law:
PART I — PRELIMINARIES
1. Short Title and Enactment
(1) This Act may be cited as the ‘Declarations Restoration Act’
(2) This Act shall be enacted immediately upon its signage.
(3) This Act has been authored by Representative EATB.
(4) This Act has been co-sponsored by Representative Stanley582 and Representative Gluonmaster.
(5) This Act amends the following acts:
(a) Electoral Act
2. Reasons and Intent
(1) The passage of the Declarations Act unnecessarily complicated the election declaration process by forcing candidates to differentiate between their ticket and other party memberships, placing a heavier administrative burden on the Department of State, candidates, and party leaders.
(2) The previous system functioned fine: if a political party did not
wish to endorse a candidate claiming affiliation, they could simply contact the Department of State to have it removed.
(3) This bill reverses the changes made by the Declarations Act, restoring Section 4 of the Electoral Act to most of the original text with slight changes.
PART II — AMENDMENTS TO THE ELECTORAL ACT
3. Reversing the Declarations Act
(1) Section 4 of the Electoral Act shall be amended as follows:
"4 - Electoral Terms and Limitations
(1)
(a) the political party, if any, on whose ticket they are running; and
(b) every political party of which they are a member. (2) A candidate who is not running on the valid ticket of a political party shall run as an independent, regardless of any political party memberships declared under subsection (1)(b).
