Amend the Criminal Code Act​

The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 — Short Title and Enactment
(1) This Act may be cited as the “CCA Cleanup and Enhancement Act” or the “Criminal Code Act Cleanup and Enhancement Act”.
(2) This Act shall take effect immediately upon signage.
(3) This act is authored in different parts by Speaker Multiman155 and DHS Sergeant Rookieblue14.
(4) This act is sponsored by Speaker Multiman155 and co-sponsored by Rep. Scassany

2 — Reasons
(1) A listed high crime in the Criminal Code Act has the wrong name;
(2) Resisting arrest has become almost impossible to charge following the CCA’s passage without discernable benefit;
(3) There is a desire to tweak trespass in order to better deter it and fix a clear typo;
(4) Careless Driving's definition could be better written in the context of the Commonwealth of Redmont;
(5) The penalty for Frivolous Court Case is so low as to not meaningfully deter frivolous filings;
(6) To amend the Criminal Code Act in order to clean up the above issues;

3 - Amendments to Part I, Section 8 of the Criminal Code Act
Part I, Section 8 of the Criminal Code Act is hereby amended as follows:

(8) Statute of Limitations​

(a) Except for claims arising from High Crimes, aAll legal action must be commenced within four months of the date of the alleged offense; OR within 2-months of becoming aware of the offence, if outside the Statute of Limitations 4-month timeframe.​

(b) High Crimes excepted from the time constraints of the Statute of Limitations include:​

(i) Corruption​

(ii) Violating a Whistleblower's AnonymityWhistleblower Anonymity Violation​

(iii) Electoral Fraud​

(iv) Treason​

(v) Political Espionage​

(vi) Breach of Integrity​

(vii) Bribery​

(viii) Whistleblower Suppression​

4 - Amendments to Part V, Section 8 of the Criminal Code Act
Part V, Section 8 of the Criminal Code Act is hereby amended as follows:

8 - Resisting Arrest​

Offence Type: Summary​

Penalty: 1 Penalty Units​

A person commits an offence if the person:​

(a) disregards or defies a directive given by a law enforcement officer while being arrested.; or​

(b) escapes from handcuffs; or​

(c) disconnects from the server after being handcuffed.​

5 - Amendments to Part VIII, Section 2 of the Criminal Code Act
Part VIII, Section 2 of the Criminal Code Act is hereby amended as follows:

2 - Trespass​

Offence Type: Summary​

Penalty:​

(a) First offence - 3 Penalty Units​

(b) Second offence - 5 Penalty Units + 5 min imprisonment​

(c) Subsequent offences - 7 Penalty Units + 105 min imprisonment​

A person commits an offence if the person:​

(a) enters or remains in a non-public or restricted area against instructions.​

(ba) is a landlord and enters a tenant's region without reasonable prior notice, unless an exemption applies.​

6 - Amendments to Part V, Section 7 of the Criminal Code Act
Part V, Section 7of the Criminal Code Act is hereby amended as follows:

7 - Careless Driving​

Offence Type: Summary​

Penalty: 1 Penalty Units​

A person commits an offence if the person:​

(a) drives off-road, on sidewalks, or otherwise improperly;​

(b) blocks traffic, speeds, drives on the wrong side, or endangers others;​

(c) drives while under the influence (≥25% BAC).​

6 - Amendments to Part III, Section 4 of the Criminal Code Act
Part III, Section 4 of the Criminal Code Act is hereby amended as follows:

4 - Frivolous Court Case​

Offence Type: Summary​

Penalty: 100 Penalty Units, or 10% of the value of the monetary value of prayer(s) for relief; whichever is higher​

A person commits an offence if the person:​

(a) lodges a legal case that has no serious purpose or value.​
