BILL
TO

Amend the Congressional Process

The people of Democracy Craft, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as the " Congressional Process Amendment Act January 2021"
(2) This act shall take effect upon signage
(3) Co-authored by Leonardo Augustus

2 - This is to give the Congress the ability to impeach a President if needed due to a continuous wrong-doing of a President.

3 - "5) Motion of Presidential Impeachment" is added:
(1) When a President has been doing wrong continuously for a long period of time, the Congress has the ability to propose a motion of Presidential Impeachment, which will remove the President from their position and will lead to Special Presidential Elections. This is a very serious matter and cannot be considered for the smallest mistake made by a President, it must be a continuous wrong-doing or a really big mistake made by the President such as a big unconstitutional action. The process to propose this motion will be as follows:
1- A poll is set in the #house-announcements channel to know whether Representatives agree or not with the motion.
2- If the poll passes the House, a new poll is set in the #senate-announcements channel to know whether Senators agree or not with the motion.
3- If the poll passes the Senate, a new poll is set in the #congress-chat channel to know whether the Congressmen/women want to make an in-game session or in forums.
4- If forums is the option decided, it will proceed as a normal forums court case.
5- If in-game session is the option decided, the procedure will be as follows:
5.1.- The impeachment announcement will be brought to the President and a date will be chosen.
5.2.- When the date arrives, the session will be take place in the Congress Court in the 2nd floor of the Congress, presided by a Committee.
5.3.- The Committee will be formed by 2 Representatives (from the 2 parties with the most seats, if possible), 2 Senators (from the 2 parties with the most seats, if possible) and 2 Judges and the Speaker as the President of the Committee. If only 1 judge is available, the President Pro Tempore shall replace them.
5.4. - Before the session begins, everyone shall take oath before the Constitution, swearing to be truthful and loyal to the Constitution.
5.5. - The session will then begin, following a normal in-game court procedure.
5.6. - After all questions have been asked, the Committee will decide the final decision and will impeach the president or not.
5.7. - If the President is impeached, they will have to leave the position immediately and Special Presidential Elections will take place to fill the seat until the next established elections.
5.8. - The judges will then decide if the President will be charged between $4k and $25k to the President due to the damage made and/or serve up to 30 minutes of prison.
