CONGRESS OF THE
COMMONWEALTH OF REDMONT
A BILL TO
AMEND THE CRIMINAL CODE ACT TO FURTHER DEFINE TRESPASS CHARGES
AMEND THE CRIMINAL CODE ACT TO FURTHER DEFINE TRESPASS CHARGES
The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:
PART I - PRELIMINARIES
1. Short Title and Enactment
(1) This Act may be cited as the “Better Criminal Trespass Act”.
(2) This Act shall be enacted immediately upon its signage.
(3) This Act has been authored by _GreyMC and Representative antonfr.
(4) This Act has been sponsored by EmeraldGuuy and co-sponsored by antonfr.
(5) This Act amends the following acts:
(a) Criminal Code Act
2. Reasons and Intent
(1) Trespass is loosely and poorly defined in the Criminal Code Act, which fails to include important cases such as trespassing on government property and times when someone has been excluded from a property after they lawfully entered.
PART II - AMENDMENTS TO THE CRIMINAL CODE ACT
(1) Part VIII, Section 1, of the Criminal Code Act shall be amended as follows:
1 - Trespass
Offence Type: Summary
Penalty:
(a) First offence - 3 Penalty Units
(b) Second offence - 5 Penalty Units; 5 minutes imprisonment
(c) Third offence - 7 Penalty Units; 10 minutes imprisonment
(d) Subsequent offences - 10 Penalty Units; 10 minutes imprisonment
A person commits an offence if the person:
(i) to have this offence be proven, a government employee must use the /inspect command to ensure no edits had occurred afterwards.
(a) enters an area that has been restricted to public access via locked doors, barriers or other obstructions; or
(b) enters an area that has been restricted to public access via a no trespassing sign, written notice, or any other form of communication visible from every entrance; or
(i) If there is any doubt as to the existence of such communication at the time of the offence, a government employee must have used the /inspect command to verify that no edits have been made to it.
(c) enters any restricted government property such as but not limited to Revcatraz; or
(d) has failed to leave the property after being requested to leave by the owner, a lawful resident or added member of the property.
(i) For the purposes of this section, an added member shall also include any person who is lawfully employed or otherwise authorized to manage or operate the property.
This offense shall not occur when:
(a) a government employee is acting in their official capacity when authorized by law.
