Disband and replace the Redmont Bar Association

The people of Democracy Craft, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as the “RBA Disband & Replace Act”.
(2) This Act shall be enacted immediately upon its signage.
(3) The Act has been co-sponsored by: Rep. Azdrus, Rep. ReinausPrinzzip, Senator xerxesmc, Rep. FracturedGhast7
(4) The Act has the support of all 4 incumbent Redmont Bar Association Council members: nnmc, AlexanderLove, BananaMuffin, and Aladeen
(5) The Act was authored by RBA Councilman and former RBA Chairman nnmc.

2 - Reasons
(1) In the eyes of many citizens and lawyers, the Redmont Bar Association (RBA) has become overly bureaucratic, full of infighting among leadership, and thus ineffective at its main jobs of investigating and punishing wrongdoing by lawyers and managing public defenders.
(2) All 4 incumbent RBA Council members agree with that assertion, and all 4 would like to see the RBA disbanded and replaced with a different organization that will more effectively carry out the responsibilities of the RBA.
(3) Judicial officials are already somewhat responsible for investigating and punishing wrongdoing by lawyers. Judicial officials are the ones who issue fines for frivolous court cases. The judicial officials are also capable of managing public defenders because they are the ones who currently request public defenders in cases they preside over.

3 - Disbanding the RBA
(1) The RBA is hereby permanently disbanded and shut down. The RBA shall cease to exist and is absolved of all of its powers, duties, and responsibilities.

4 - Replacing the RBA
(1) The Redmont Legal Oversight Board (RLOB) is hereby established.
(2) The membership of the RLOB shall consist exclusively of incumbent Magistrates, Judges, Justices, and the Chief Justice.
(3) All incumbent Magistrates, Judges, Justices, and the Chief Justice shall be required to serve on the RLOB and carry out the duties of an RLOB member.
(4) The incumbent Chief Justice, in addition to being an RLOB member, shall be required to hold the position and carry out the duties of President of the RLOB.

5 - Powers and Responsibilities of the RLOB
(1) Investigate, and if necessary punish, lawyers who may have committed wrongdoing.
(a) The RLOB may issue as punishment to lawyers: formal warnings, temporary disbarment, and/or permanent disbarment. Disbarment is defined as forbidding a lawyer from filing cases or doing other legal work on behalf of clients. The RLOB must vote to issue punishment, with a threshold of at least two-thirds of RLOB members voting in favor of a punishment for that punishment to be issued.
(b) The RLOB may at their discretion set the guidelines for what is and isn't wrongdoing by a lawyer, provided that these guidelines do not contradict existing laws or the Constitution.
(2) The RLOB may adopt and repeal by-laws to govern itself, provided that these by-laws do not contradict existing laws or the Constitution. By-laws must be voted on in order to be adopted or repealed. It shall take at least two-thirds of the RLOB members to vote for the adoption of a by-law, or the repeal of a by-law.

6 - Powers and Responsibilities of the RLOB President
(1) Responsible for the initial organizing of the RLOB, as well as responsible for managing and overseeing the functions of the RLOB
(2) Manage the Public Defenders Program (PDP)
(a) The President of the RLOB shall be Director of the PDP
(b) The Director of the PDP has exclusive power to hire and fire public defenders, and to assign and un-assign public defenders to clients

7 - Conflicts
(1) Any sections, subsections, or sub-subsections of previous Acts of Congress that conflict with this Act are hereby declared null and void.
(a) If only part of a previous Act of Congress is conflicting with this Act, then the non-conflicting parts shall remain extant.
