To

Amend the Modern Legal Board Act

The people of DemocracyCraft, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as the “Modern Legal Board Act Amendment”
(2) This Act shall be enacted immediately upon passage.
(3) This act has been authored by Mhadsher101.
(4) This act has been co-sponsored by MilkCrack and supported by ⅗ of the RBA Council: Councilman Aladeen, Councilman RelaxedGV, and Councilman Gertis7.

2 - Reasons
(1) The RBA is over-bureaucratic. There are too many roles and too little activity.
(2) There is no oversight over the RBA. While the organization has maintained its independence since its creation, it has failed to regulate itself in times of low activity and efficiency.
(3) One of the Council’s main roles, the ability to disbar, has been removed via lawsuit verdict. The Council now does little and is ridden with inactivity, with the Committees that are doing much of the work being made up by volunteer lawyers. This claim is supported by three out of four of the current Council members.

3 - The Modern Legal Board Act will be amended as follows:
Section 5 will be amended as follows:

(3) The Board shall be managed and led by an elected Council of four.
(4) The Board and Council shall be overseen by an elected Chairperson.

4 - Section 6 will be amended as follows:

(1) The Council shall consist of four elected barristers and/or attorneys, elected for a period of two months.
(2) The Council shall be responsible for enacting, amending, and repealing RBA policy, as well as overseeing the Public Defender Program and all other RBA programs.
(4) The Chairperson shall act as the Speaker of the Redmont Bar Association, appoint all RBA officers and committee Chairpersons, and directly supervise all RBA programs. The Chairperson shall also maintain order and decorum within the RBA council. The Chairperson shall act as a fifth member of the Council, but may reserve their vote for a tie-breaker.
(5) The Department of State shall manage the elections for the Council and the Chairperson in a fair and impartial manner.
(7) The current RBA Council and Chairman shall hold their offices until January 20th, 2022.

(1) The Council is disbanded.
(4) The Chairperson shall act as the Speaker of the Redmont Bar Association, appoint all RBA officers and committee Chairpersons, directly supervise all RBA programs,
and enact and amend RBA policy.
(5) The Department of State shall manage the elections for the Chairperson in a fair and impartial manner.


5 - Section 9 will be amended as follows:

(2) A councilor of the RBA may be recalled by the Board should at least ⅔ of all voting lawyers agree to this removal. A special election to fill the vacancy shall take place immediately, administered by the Department of State.
(3) Upon proposition by a member of the Council, the Board, with the assent of ¾ of all voting lawyers, may issue a vote of no confidence, where then the entire Council, including the Chairperson, shall be removed from their offices, and a general election shall be triggered. The term of the current council shall be erased, and the two months will begin once more.

(2) The Chairperson is charged with maintaining the activity and efficiency of the RBA.
(3) Congress or Cabinet may motion for a vote of no confidence in the Chairperson, which upon supermajority support from one will immediately trigger a special election for the position, with the removed Chairperson unable to run as a candidate.


6 - Section 10 will be amended as follows:

(1) The Redmont Bar Association shall permanently maintain a Public Defender Program, which an appointed officer selected by the Chairperson shall direct.


To:
(1) The Redmont Bar Association shall permanently maintain a Public Defender Program, which the Chairperson shall direct.
 

Veto

This bill has been vetoed for the fact that it was drafted without the approval of the incumbent RBA Chairman, and none of the Council members supporting it have retained their positions.

According to the Chairman, RBA Council members have been helpful in assisting with administrative tasks and proposing new initiatives. I do not wish to add the burden of dictatorial RBA management to Drew without the agreement of either him or the Council; it seems that the RBA is fine with its current structure, and the presence of a Council is not causing any active harm to the server.

Additionally, I see issues in giving unilateral influence over our legal profession to a single member of the RBA; at least the presence of a council mitigates that possibility.
